A California appeals court on Thursday ruled that the government can remove an out-of-control child from the custody of parents even if the mother or father is not at fault. According to the court, if the child is at risk of harming themselves that is reason enough. The ruling came in the case of a Los Angeles County mother whose teen daughter repeatedly ran away from home and had a child at age 15.
“When a child thereby faces a substantial risk of serious physical harm, a parent’s inability to supervise or protect a child is enough by itself to invoke the juvenile court’s dependency jurisdiction,” the court said. Read more.
