Lawyers at the International Criminal Court have decided that any crimes committed in the context of the interception and takeover of the Mavi Marmara by IDF soldiers on 31 May 2010 were not of sufficient gravity to fall under the court’s jurisdiction, according to court papers seen by Reuters on Wednesday.
The Mavi Marmara was registered to the Comoros Islands, which referred the raid to the court.
“The Mavi Marmara was deliberately reflagged several days before she set sail,” said Nick Kaufman, an Israeli lawyer who represents clients before the ICC. “This allowed the Union of Comoros to be exploited as a jurisdictional vehicle for the continuing and obsessive lawfare against Israel at the ICC.”

Hmm, let’s see. The Rome Statute, which created the ICC, mandated that the ICC has jurisdiction over four areas: (a) the crime of genocide; (b) crimes against humanity; (c) war crimes; and (d) the crime of aggression.
Genocide-the Israelis were not trying to wipe out the Turks by the Mavi Marmara; Crimes against humanity-requires a widespread attack, which did not exist here; War crimes-according to the ICC this is Geneva Convention violations, like directing an attack against civillians, which did not happen in this case; Aggression-according to the ICC this requires planning, which did not happen in this case.
Quite simple and there should have been no deliberation about this issue.
Moreover, and perhaps more pronounced, Israel never ratified the Rome Statute. International law is based on treaties, and Israel is not bound to this treaty. The ICC has no jurisdiction over Israel. If I convene a tribunal to judge matzav.com guilty of war crimes then you would laugh. Same here.
See here is the thing. They don’t want to investigate because then they would have to admit that the boat was full of illegal arms to give to the Palestinians to go ahead and kill Israelis.
