Hearing Seeking New Trial for Rubashkin Set in Appeal

shomom-mordechai-rubashkinDes Moines, IA – A hearing seeking a new trial for Reb Sholom Mordechai Rubashkin is scheduled before the U.S. 8th Circuit Court of Appeals.

Documents filed Monday show a hearing before the St. Louis court is set for June 15.

Reb Sholom Mordechai was sentenced to an absurd 27 years in prison. His arrest followed an immigration raid at the company’s Postville plant in 2008.

His attorneys sought a new trial after evidence showed Chief U.S. District Court Judge Linda Reade, who presided over Rubashkin’s trial, was involved in the planning of the raid. Rubashkin’s attorneys argued Reade could not be impartial and should have recused herself.

Reade rejected the request and Rubashkin’s attorneys appealed to the federal court

  1. Is no one interested in Rubashkin’s fate? A few short months ago, a story like this would have generated dozens of responses.

    Judge Linda Reade should be locked up for life!

  4. I hope this judge ends up going to jail. If one reads the minutes of the tries it becomes clair this man did not get a fair trial. I have no idea why the lawyers didn’t take this up in middle of the trial, to demand another judge.
