Israeli Supreme Court Interferes With Get

The Israeli Supreme Court extended an interim order preventing Chief Rabbi Yitzchak Yosef from convening his Beis Din Hagadol to discuss whether a get zikui given by a Tzefas beis din to the wife of a husband left comatose after a 2007 motorcycle accident was valid.

Rav Yosef was acting in response to an appeal against the Tzefas ruling submitted by a certain Reuven Cohen of Bnei Brak, who was unconnected with the get case.

The agunah advocacy group Mavoi Satum subsequently appealed to the Supreme Court on behalf of the divorced woman to block the Beis Din Hagadol from adjudicating her case.

“This appeal is not in place,” Deputy Chief Supreme Court Justice Elyakim Rubinstein said in explanation of his decision. “Should a beis din judge a case when a man from the street with no connection to the case comes in and submits an appeal? He should be shown the door immediately. Who would touch such a case?”

Attorney General Avichai Mandelblit agreed that procedurally speaking, “The Beis Din Hagadol has no authority to adjudicate an appeal submitted by a third party even if it rejects the halachic decision [made by the first beis din].”

  1. This “psak” sets a precedent which is relevant to each and every Jew, whether he happens to be on street, his house, the Beis Midrash, or anywhere else. The Tzfat “Beit Din” has no right to misrepresent Hashem’s commands because they think that their emotions are more important to them….

      • Sir, that’s exactly why the the chief Rabbi set up a real Beis Din to review it, which you acknowledge is relevant to every Jew.

        Oh, every notable rabbi and Beis din said that their psak is contrary to Hashem’s commands. Yeah. Nice try though

        • That is not a real Beit Din. Why? Because you can not have a real Beit Din just like that out of the pocket of a certain Rabbi when an random am haaretz from the street is asking for it. Go back to the seforim and study!
