A woman who fled from Yemen in 1993 with six children has been unable to marry ever since as her much older abusive husband to whom she was forcibly married converted to Islam and could not be located due to Yemen’s tumultuous political climate.

After extensive research, Rav Abiran Yitzchak Halevi of the regional Beis Din of Tel Aviv wrote a 250-page psak which gave 19 reasons why the marriage never took place.

These include proofs that the marriage was coerced, the witnesses to the marriage were invalid, the wedding was conducted incorrectly and that the mesader kiddushin was unqualified.

He concluded that the woman “has the status of an unmarried person who may marry whoever she pleases and even a kohen, and her status is as if she never married.”

  1. Did a Bais Din of three sign the psak? If so, please obtain it and post it. If not is this Rov’s dass yocid meaningful?

    • Ask Rav Moshe, the Nodie Beyuday and every Posek ever they give a psak and if the rov thinks its a huge chidush he sometimes puts a disclaimer that the psak is dependent if more rabonim agree to it, but that is the exception not the rule.

    I would LOVE to see the written psak as to the reasoning why she could marry a Kohen.
    Given that she was never married, BUT she DOES have children.
    In this case wouldn’t it be considered children out of wedlock? Shouldn’t that bar her frm marrying a Kohen?

      I think you need to learn the basics of halachah, a kohen can marry someone who was never married even if she has kids out of wedlock, he can also marry her if her 1st husband died (but only if the 1st husband has at least 1 child, or no siblings) & as long as she did not have relations was a non jew.
