Obama Loses at the Supreme Court

supreme-courtThe Supreme Court ruled unanimously today that President Obama’s move to fill three seats on the National Labor Relations Board in 2012 using recess appointments exceeded his power.

The Court ruled that the Senate was not truly in recess when Obama made the appointments. (When in session, Republicans were blocking the appointments.) However, the court uphold the president’s ability to make recess appointments in general.

In his majority opinion, Justice Stephen Breyer declared that a congressional break has to last at least 10 days to be considered a recess under the Constitution. Read more at The Los Angeles Times.
