Open Orthodoxy Considers Alternatives to Replace Kiddushin

Concerned for the plight of agunos, women whose husbands refuse to give them gittin, Open Orthodoxy is considering an alternative to kiddushin, as mandated by halacha, Jewish Standard reports.

“This is one of the issues that is most pressing in the Jewish community, because kiddushin happens across denominations,” said Rabba Yaffa Epstein, who was ordained by Yeshivat Maharat. “Every denomination uses kiddushin as the main way in which marriage is enacted in their community.”

Yedidah Koren, a faculty member at the Drisha Institute and Machon Hadar, presented some new alternatives at a recent JOFA session. A revolutionary shift would be to modify the kiddushin process.

“Making kiddushin conditional enables the woman to have agency in dissolving the marriage. A woman can request a divorce, and if it isn’t not given to her, she can move out. But maybe it’s better to think what a halachic marriage can be if it’s not kiddushin,” said Koren, according to Jewish Standard. “It enables creativity and starting to think what a Jewish marriage can be.”

“I would argue for a completely new marriage ceremony, because the reality of our world does not match what the halacha of kiddushin actually is,” Epstein said.

Harav Shlomo Miller Shlita has stated, as was posted previously, that in his opinion, we should not refer to this group as “Orthodox”, even with the adjective “Open”, as it may lead people to believe that they are indeed within the Orthodox camp, while in truth they are no different than the Reform movement in its early stages.

    Why don’t you respect this Daas Torah, and at least put the word ORTHODOX(Y)) in QUOTATION MARKS?

    Open orthodox leaders support toeiva marriage and welcome them in their temples. So if toeiva couples can throw a kiddish,anything goes.

  4. Matzav is not reporting about innovations that the Conservative or Reform/Liberal movements are coming up with. So why reporting about the right-wing aka OP (Open Orthodox) of the Conservatives?

    Not being committed to God is not being an Orthodox Jew…
    Not being committed to a marriage is not being married…

    These people are still looking to be excepted within our circles so they look for excuses and create confusion so the average person gets confused thinking their maybe something to this..
    it’s time we stop paying attention to them and let them know we consider them sinners…

  9. I’m all for their doing away with kiddushin. Who says their gittin are kosher, who says their constituents can be relied upon to seek a get, who says that in due time they won’t annul kiddushin.
    Better for these guys not to do kiddushin. Also, it will further distinguish this group from Orthodoxy. Somewhat akin to the Rabbis encouraging the early Christians to keep Sunday instead of Saturday, to keep themselves distinct.

  10. This movement has zipped past Conservative and Reform in a few short years in their rush to the cliff of oblivion. By definition, most of their members will not be Jewish in a generation or two.

Since what is actually being acquired, she said, is not the person, but rather the person’s [ED:marital] exclusivity — a wife after all can’t be resold in Jewish law — there would be no reason a woman couldn’t similarly acquire her husband”

    Perhaps, she suggested, a mechanism of oaths and vows could be used to create a halachically binding relationship, in which the partners pledge [ED:marital fidelity to each other. “I would argue for a completely new marriage ceremony, because the reality of our world does not match what the halacha of kiddushin actually is,” Rabba Epstein said.

    What about “Kiddushin,” the talmudic tractate on the topic?

    “So many tractates we have are already theoretical,” Ms. Koren said, pointing to talmudic discussions of Temple sacrifice.

  15. Matzav should keep throwing the mud on them. That’s the way for everyone to see them falling off the cliff. And regarding the kiddushin, the mekadaish should be the same gender as the officiating clergy. P. S. It is funny that in middle of this article about this “rabbit” there is an ad for the book about Rebbetzin Machlis, go figure.

I can’t speak for Matzav’s mindset, but the answer to those who ask why it is so important to keep reporting these breaches is because unfortunately there are still many in our camp who haven’t come to realize the terrible danger of this break-off group, and still wonder why the rabbanim and gedolim have come out so harshly against them. “What’s with Shalom, kiruv, ahavas yisrael etc. etc?,” they ask. No one questions the strong stance anymore when it comes to Conservative and Reform, and that’s why this group still needs to be treated differently, and their terrible actions continuously publicized.
