Rabbi Dr. Moshe Tendler Castigates England’s Chief Rabbi and the RCA Over Organ Donation

Tendler, a biology professor and Jewish medical ethics expert at the Yeshiva University and rosh yeshiva at Yeshiva Rabbeinu Yitzchok Elchonon – who in the early 1990s developed for the Rabbinical Council of America a health care proxy that determined that brain-stem death constituted halachic death, had strong words for the chief rabbi of England, Rabbi Jonathan Sacks, on the issue of brain stem death and organ donation. Rabbi Tendler’s remarks were made this past week during a lecture in Eretz Yisroel.

In the video, Rabbi Tendler states, “Somebody asked [Rabbi Sacks] what about this business about getting without giving? That you can get an organ from a brain stem patient because he is dead but you can’t give it because you are alive? To which the Chief Rabbi answered, “That is a spurious question.” Spurious question? …Spurious means irrelevant… He used the word so that no one else would understand what it means. [Assemblage laughs.] …A man who has mastered the language for clarity…suddenly is mumble bumble…don’t know what he is talking about. There are tremendous, tremendous political issues that are here that I don’t understand.”

  1. If brain death = death, then there are plenty of people walking around who are legally and halachically dead, from the neck up anyway.

  2. Here’s the dictionary definition of spurious. A spurious claim is not irrelevant, it’s without merit. He was discrediting it.

    2. Biology . (of two or more parts, plants, etc.) having a similar appearance but a different structure.
    3. of illegitimate birth
