Rav Elyashiv Attends Birchas Hachama Before Great-grandson’s Bris Despite Rule of Todir

rav-elyashivMaran Rav Yosef Shalom Elyashiv shlit”a had the bris of a great-grandchild this morning, and he paskened that despite the normal ruling of todir vesheino todir todir kodem, which would mean that the bris has priority over Birchas Hachama, in this case the bracha over the sun had priority and was done first, before the bris. Some have suggested as a reason for this p’sak that the bracha on the sun is meant to be said in the first three hours of the day and after that the bracha can no longer be said b’sheim umalchus, whereas a bris can be done all day (even if the preference is for early in the day).

Another interesting tidbit is that Rav Elyashiv makes sure to go to the Kosel every month and he therefore never needs to tear kriah there. Recently, he has not been feeling so well, and it seems that he had not gone to the Kosel in over two months. This means that he would have been required to tear kriah when going to the Kosel for Birchas Hachama. Out of concern that tearing kriah, being a sign of mourning for the destruction of the Bais Hamikdosh, would dampen the joyous occasion of Birchas Hachama, Rav Elyashiv was scheduled to go to the Kosel yesterday to tear kirah in advance of today’s visit for Birchas Hachama.

  1. The principle of “tadir v’sheino tadir, tdair kodem” only applies to mitzvos – a birchas hashevach, especially a birchas haroeih is not covered by this principle.

  2. This headline should begin, “Rav Elyashiv paskened…” instead of creating an impression that someone thinks the Gadol HaDor erred, chas v’shalom, in this cheshbon.
