rav-moshe-shternbuchRav Moshe Shternbuch, Raavad of Yerushalayim, has reiterated the opinion of the gedolei haposkim of this generation and last generation that ascending the Har Habayis is forbidden according to halachah.

It is a kareis violation to go onto the Har Habayis, said Rav Shternbuch in an address at his yeshiva in Ramot, Yerushalayim.

“The Ribono Shel Olam is upset at those” who go on to the Har Habayis, he said, adding that people who support visiting the Har Habayis erroneously “speak in the name of the Torah” and also provoke the Arabs, thus “bringing about terror attacks.”

Rav Shternbuch said that shomrei Torah umitzvos must battle the “Mizrachim” who dilute Yiddishkeit with their compromises.

“Hundreds have been seen ascending the Har Habayis, violating an issur kareis,” he said. “They don’t just visit, but then attempt to justify it and prove that it is acceptable according to the Torah…. [Their actions lead to] hatred, and we have already seen korbanos result, and there will be more korbanos until they cease their activities on the Har Habayis.

  1. One should keep in mind the history involved with this bitter feud. The Arabs never stopped blaming Israel for the attempted arson of the dome of the rock by a deranged non Jew over forty years ago. In addition, Israel has shut its eyes to the massive destruction on important archeological material on Har habayis by the Arabs over the last 10 years. This basically gave them an assumption of having complete control

  2. The rav added this is what the Chazon Ish and the Brisker spoke of, that ‘Mizrochim’ are the most dangerous and we must fight against them for they are fifth columnists foisting an approach of diluting compromise , compelling us to fight to the end

  3. The Lubavitcher Rebbe also paskened that it is prohibited to walk on the Har Habayis, and he refused to discuss the areas that may be permitted, because it might lead others to go to the prohibited areas, c’v.

  4. ???????? ?????????, ?????????: ??????-??? ??????????? ???????? ???-???????, ????????? ????? ???????

HaGaon Rav Shternbuch seems to be quoting the RambaM (Beis HaBechira 6:15-16)

    ????? ??????? ??????? ???? ??”? ???? ?? ??? ????. ??????? ???? ????? ??? ????? ??”? ???? ????? ????? ????? ?????? ??????? ????? ???? ????? ??? ??? ??????? ?? ?? ?? ???? ?? ????? ??????? ?????? ???? ????? ????? ????? ???

if there is Kedusha, then some Korbanos can and should be brought…

    However the RambaM:

    ?”? ???? ???? ??? ?? ??? ????? ???? ?? ????? ?????? ????? ?? ??? ???? ???? ????’ ???? ????? ?????? ???? ??”? ????? ?????? ?? ???? ????? ??? ?? ??? ??? ???? ???????? ???? ?”? ??? ??? ??? ???? ???? ?????? ???? ???? ???? ????? ????? ???? ????? ??? ?? ??? ??? ???? ?”? ??? ???????? ?????? ?? ??? ??? ???? ???? ???? ?????? ???????? ?????? ??????? ??????? ????? ??? ????? ????? ?”? ????? ?? ???? ?? ???? ?’ ?????? ????? ????? ??? ?? ??? ?? ???

The Chasam Sofer has a Teshuva that seems to support the idea of Korban Pesach Bizman HaZeh..

  5. I think that the issur kareis referred to is really not on the whole area, but the exact line as to where the issur starts isn’t clear.
When Israel first captured it, it was felt that to appease the Arabs and minimize trouble Jws would be kept out and most Jews that would have been interested were aware of the issur and therefore had no problem with it. The Arabs, by using it as a base from which to throw stones basically ruined it. Jews needed to to defend themselves by going up and thereby breaking the ice. Now soldiers need to go up and once some go up, others want to also.

  6. While many Rabbonim forbid going on the Har HaBayis, there are also many who allow it with the proper preparations. If someone is a follower of one of those Rabbonim, and they are just following the psak of their Rav, there is absolutely nothing wrong with it.
