Rav Yosef: Those Who Go On to the Har Habayis Are Chayov Kareis

rav-ovadiah-yosefLast week, Matzav.com reported that over 500 people went up to the Har Habayis last Monday night and Tuesday to mark Tisha B’Av. Matzav.com was heavily criticized by some for stating in its headline that these people had violated halacha by going up to the Har Habayis.

The large majority of poskim of this and previous generations have ruled that, halachically, Yidden should not go on to the Har Habayis because of concerns that people who are tamei will enter areas that tamei people are not allowed to enter – an issur krisus.

Some of those behind the recent efforts to have people ascend the Har Habayis claimed that they receive a p’sak from Rav Chaim Kanievsky, Rav Shmuel Wosner and Rav Ovadiah Yosef.

Rav Yosef, however, responded this week to the actions of these people, strongly condemning them.

“It is assur to enter the Har Habayis,” he said, “as we are all considered tamei meisim.”

“According to the Rambam, one who enters the Har Habayis is chayov kareis,” he said.

Rav Yosef Shalom Elyashiv and others have likewise stated clearly that going on to the Har Habayis is halachically forbidden.

Altogether, members of the Western Wall Foundation said, about 1,000 Jews had ascended the Har Habayis during the Three Weeks period, between the 17th of Tammuz and the 9th of Av.

  1. Once again you misrepresnt the statements. We are talking about areas that were not at all part of the Azara. We are talking about the areas that Herod added. Consequently, It is those aras that the Poskim who permit the entry do so. Let’s keep to the facts.

  2. Didn’t Shevet Binyamin attempt to go to Eretz Yisroel after Moshe related HaShem’s punishment for the Chet haMeraglim would be 40 years in the midbar? Did they get far? They all were kileed in an attack.
    If the chachomim say not to do something then that IS THE RATZON OF HAKADOSH BARUCH HU! P*E*RI*O*D!!!

    there is a big difference between saying

    and

    “According to the Rambam, one who enters the Har Habayis is chayov kareis,” he said.

  6. I think you just proved your critics’ point: you bring a single posek to support your contention that there is no possible way that these yidden had any halachic support for what they did!
    I’d offer you a shovel but you seem to pretty good at digging holes…

  7. Why do people post these half baked stories full of misinformation. Everyone knows being chayav kores depends where you walked, if you were tovail in a srping, and a host of other criteria.
    This story is worthless.

  8. It’s a maklokes Rishonim in regards to which parts we can go on. As well some parts we can go on if one goes to a normal mikveh, for other parts this wouldn’t be enough. I guess the gedolim were macriah l’chumra in all these areas, perhaps since it’s hard to psaken only working with Rishonim? Maybe matzav.com would like to post some material on this (written either from the present gedolim, or past or the rishonim themselves.) Mentioning names is already becoming old and loosing credibility as we see in this case (either way)…

    “Only the “Azarah” area had the Chiyuv Kareis.
    That is 187 by 135 Amos, or roughly 5% of present day “Temple Mount”.

    If these people didn’t tell the truth about Rav Yosef, why should we believe what they say about Rav Kanievsky and Rav Wosner?

  12. #19 . Mocking Chaza”l is definately not the way !! And besides what’s this 1,000, 5,000 years ? Chaza”l say that the world will stand for 6,000 years and the Rambam writes that the Torah promised that Moshiach will come before that…. we’re waiting with emunah ….

  14. Yasher Kochachem (sincerest appreciation) to Matzav.com for publicizing this very important matter. Because of differing opinions (the RADVAZ, Rav Eshtori HaParchi, and others) regarding the actual MeKom HaMikdash (location of the Holy and Holy of Holy sites) entry to most of the Har HaBayis (Temple Mount) is prohibited.

    This prohibition was declared by over fifty leading Rabbanim — representing the full spectrum of Orthodox Jewry — in the Hodaah VeAzharah (Warning) document of Elul 5727 (August ’67):
