charles-j-hynes-2[Videos below.] In a video interview with the Five Towns Jewish Times, Brooklyn District Attorney Charles J. Hynes speaks out about the harsh sentence handed down against Sholom Mordechai Rubashkin. He compared some of the federal cases to local cases, explaining why the local system is in many ways superior.

Mr. Hynes then discussed potential terrorism in Brooklyn, as well as street gangs and what can be done about them. Other fascinating issues were discussed as well.

  1. There is no mandatory sentencing in the Federal system except for specific crimes, not including fraud. Mandatory sentencing guidelines has been held to be unconstitutional by the US Supreme Court. Judge Reade clearly had the discretion to impose a lower sentence down to and including probation. There is no excuse for a judge to rigidly follow the Federal guidelines.
