Yarmulkas Next? EU Court Says Employers Can Ban Muslim Headscarf At Workplace

PARIS – The European Court of Justice issued a non-binding ruling today that employers can prohibit the Muslim headscarf in the workplace, setting an important precedent for a continent in the midst of a fraught political climate.

As a strong anti-immigrant sentiment spreads into the political mainstream and right-wing parties soar in popularity ahead of several key elections this year, the ruling is bound to fan the flames of the long-simmering culture wars across the continent and especially in France.

The court addressed different complaints from two Muslim women – one from France and one from Belgium – who alleged that their respective employers had discriminated against them for wearing the Muslim headscarf, or hijab, to the office.

The judges concluded otherwise: “An internal rule . . . which prohibits the visible wearing of any political, philosophical or religious sign does not constitute direct discrimination.”

Courts in France and Belgium will be left to settle the particular disputes in question.

The Netherlands will vote on Wednesday in parliamentary elections in which the far-right populist Geert Wilders has already succeeded in bringing his openly anti-Muslim views into the center of public discourse.

In France, still reeling from a slew of terrorist attacks in the past two years perpetrated mostly by Islamic State militants or sympathizers with French and European passports, the far-right National Front party is similarly on the rise.

Marine Le Pen, the party’s contender for president, is almost certain to qualify for the second and final round of the vote in May.

The particulars of the two cases considered in Tuesday’s ruling are different. In the absence of official internal regulations prohibiting what employees can wear to work, the court suggested, Muslim women have a stronger case for wearing the hijab to the office.

According to the court, this was true in the French case.

The plaintiff in that case is Asma Bougnaoui, a Muslim woman who worked as an engineer at Micropole, a French IT firm. She had worn the headscarf when she was hired in 2008, but a client subsequently complained to her supervisors, insisting that there be “no veil next time.” Bougnaoui refused to take it off and was eventually fired in June 2009.

Because there was no official policy banning the headscarf at Micropole, “the willingness of an employer to take account of the wishes of a customer no longer to have the services of that employer provided by a worker wearing an Islamic headscarf cannot be considered a genuine and determining occupational requirement,” the court said.

But the Belgian case presents a different scenario.

In that case, Samira Achiba, a young Muslim woman, was hired in 2003 as a receptionist by G4S, a British multinational security company. Unlike her French counterpart, Achiba had not worn the hijab at the time she was hired and had accepted an offer from a firm with a clear “neutrality” policy.

Only later did she request that she be permitted to wear the headscarf in 2006. Because of the company’s policy prohibiting any “political, philosophical or religious signs” from the workplace, Achiba was dismissed.

In a strongly secular Europe home to a growing Muslim minority – especially sizable in France and Belgium – the cases present the oft-contradictory natures of two distinct liberties: the freedom of religion and the freedom of enterprise.

The tension between the two is particularly high in a France on the eve of a historic presidential election in which much of the debate has focused on issues of identity and culture. The place of Islam in French society has become a fixation across the political spectrum.

France is likely home to the largest Muslim population in Europe, and among the most visible traces of that community is the headscarf, seemingly an eternal source of controversy in a nominally secular country committed to banning overt religious signs from public life.

Since the late 1980s, the Muslim veil has outraged the French political establishment, and the country has systematically policed what Muslim women can wear in public ever since.

In 2004, for instance, France banned the headscarf from its public schools, and in 2010, it became the first European country to ban the burqa – the face-covering veil – altogether. This past summer, following a devastating terrorist attack in the Riviera city of Nice, local authorities in the south of France attempted to ban the “burkini,” swimwear not unlike a diver’s wetsuit designed to allow Muslim women to enjoy the beach while respecting traditional codes of modesty.

The rules for public and private enterprises differ, with private enterprises often offering employees more freedoms. Although France’s ban on religious signs and symbols in public places is technically intended to include signs from other religions – including yarmulkas – critics often say that the prohibitions are disproportionately directed against Muslims, and especially Muslim women.

  1. Stop equating the treatment of Yiden to the islamonazis’: Yiden in Europe(especially in France) are already fearful of wearing kipos in public – because of the islamonazis, by the way. So whatever tightens the screws on the islamonazis, may or may not make it better for Yiden, but definitely not worse from where the things already are.

    As long as it’s not hurting anyone and isn’t a security risk people should live and let live.

      Has any libertarian country ever become Great ?

      • 1) Freedom of religion and expression isn’t just a libertarian value. And in the U.S. we have those freedoms as long as others aren’t harmed or threatened.

        2) Private sector discrimination is legal unless the victim is from a protected class (race, religion, age, gender, etc). The creation of these protected classes isn’t a libertarian value.

        3) There are different flavors of libertarianism. Many countries, especially democracies, allow a large degree of personal freedom. Allowing religious freedom is a far cry from the full libertarian slate which includes allowing suicide and hard drug usage among other things.

        4) Lastly, doctrinaire libertarians are actually against laws forbidding private-sector discrimination. In other words, they’d support the right of these French companies to openly discriminate against religious dress or even against the religion itself, i.e. a business owner could legally give his reason for firing an employee as “I don’t like Jews”.
