Yerushalayim Rabbinate Beis Din: Remove Prenup Clause

A Yerushalayim Rabbinate beis din refused to grant a couple a divorce before they annulled a prenup agreement drawn up for them by a lawyer.

The terms of the prenup were: “If the husband does not give a get within 120 days of the wife’s demand, he will have to pay $2,800 alimony monthly from the time the get is demanded until it is given, with no connection to the wife’s income from work, property, or any source whatsoever.”

“The agreement has an element of an enforced divorce; therefore we cannot summon the parties to arrange a get so long as that paragraph is in effect,” the beis din wrote.

In July, forty-four rabbis, including Rav Moshe Sternbuch, Rav Avigdor Nebenzahl and a number of leading religious-Zionist rabbis, attacked a prenup proposed by the Tzohar organization, warning that it was a destruction of Judaism and would lead to an increase in mamzeirim.

  1. How dare you give the wicked men power over the women. This abuse! We need to prod the men to give the get immediately, on demand.

  2. This is a very small peek into a very large issue which is men not giving women a GET when a marriage is over. I am sure there is a lot more to the situation then that was reported and this is only a birds eye view and a speckle of what actually occurred for whatever reasons that are unknown and will probably remain unknown unless the Bais Din or both parties choose to disclose the honest truth of what has taken place.
