A lawyer is poised to sue New York City for ordering mandatory measles vaccinations in the toughest action against the virus in US history, with refusals to vaccinate facing fines of up to $1,000 or six months in jail, according to New York Senate emergency laws.

Mayor Bill de Blasio declared a state of emergency on Tuesday, which, he said, gave him the power to require vaccinations in Brooklyn’s Williamsburg neighborhood, where more than 250 measles cases have been reported since September, particularly in the Orthodox Jewish community.

Michael Sussman, a civil rights lawyer, says there are not enough cases to warrant a state of emergency, he believes the move unlawfully targets religious groups, and he plans to have a case filed against the city by Friday.

Public health law experts say the case could swing either way; it will all rest on how deadly a judge believes measles to be.

  1. Sue them for millions of dollars. Don’t let up. De Blasio should be forced to answer 3 questions:
    1) If vaccines works so well, why ban unvaxxed people? What are you scared of?
    2) Why are vaccinated adults under 55 getting the measles? Why not those over 55?
    3) Why can the well-educated and affluent get away with vaccination as was researched and reported?

    • Aw, thank Gd for people like you. I mean, without you and your friends, some of us morons would actually trust the opinion of millions of physicians worldwide – if you can imagine such lunacy.
I just hope you can continue to guide us as doctors continue to try and trick us.

    • 1) For the umpteenth time: There are those who can’t get vaccinated due to age/health!!
      2) Just because a car from the 1960’s doesn’t work so well, let’s not use cars at all.
      3) Old story. As long as you have lot’s of money, you can get away with anything. I know a lot of rich dopes. Doesn’t mean we should have poor dopes too! Nimtza Koraches mikan umikan.

  2. Very simple to understand what is going on here. Big Pharm have taken note of what’s going on. They will try to paint the antivaxers as backward religious fanatics (=chassidim) and when this gets televised accross america, it makes the antivaxers look backward by association. Obviously they need De Blasio for this which can be bought off for a couple of bucks towards his political aspirations…..

    • Don’t need Big Pharma and Big Bird to do any of this. Anti-Vaxxers have been “looking backwards” for years now. It’s just now they are becoming dangerous to others…

  3. How is antivaxing a religious right?! Judaism doesn’t have any issur to vaccinate. These antivaxer idiots are making a joke out of the religious rights, and are causing the religious rights not to be taken seriously anymore.

    • ויקרא י”ט:י”ד Vaxxers who got the measles or were injured by the vaccination is required to warn others of the danger of the vaccine and fulfill the halachah of לפני עור לא תתן מכשול (Lifnei iver lo siten michshol) – placing a stumbling block in front of a blind person.

בבא מציעא ס”ב ע”א חייך קודמים לחיי חברך (Chayecha Kodmim) – your life takes precedence over his life. You’re not obligated to go like sheep to the slaughter and risk YOUR child’s life with vaccination that have proven to have side effects and not effective for more than 3 years.

      • Dear Muddy Walks, your entire twisted argument boils down to claiming that measles vaccine is endangering your life; than sue based on that reason – according to the US law, there’s no more right to life for a religious person than a nonreligious person. Obviously, you idiots won’t be able to provide scientific proof in court, hence your tactic of muddying water and claiming some mumbo-jumbo voodoo religion exemption, since that doesn’t need a scientific proof in court. In the process, you are sabotaging the entire concept of religious accommodation in this country. Next time, people have hard time with something real, such as smiras shabos, you idiots will burn in hell.

        • Guess what? your argument that we should sue works against you! We are not allowed to sue! You, me nor anyone esle can sue a vaccine manufacturer, or a vaccine administrator. Vaccine injury is the only thing in the US courts that no one can sue for damages. This should make you question why that is, and the answer is simple: Because vaccine manufacturers would have lost in court, and the CDC wants vaccines out there at all costs. VAERS – which is not a court has paid out close to 4 billion in vaccine injuries, and vaccine injuries are notoriously hard to proof as the medical establishment is trying to deny all proof. Ask questions, don’t dish out idiocy.
Just so you know, VAERS is your tax dollar paying for vaccine injuries. The Vaccine manufacturers have effectively vaccinated themselves against lawsuits, and made you pay the price. Just like they’re making your kids sick with vaccines so that they can earn billions on mandated vaccines. Oh what a wonderful world it would be if my product would be mandated to be purchased by all, and all lawsuits against me would be banned, and a special kangaroo court called vaers would pay for all provable damage that I have caused you, and then bill you the tax payer for paying out those injuries.

          • Dear Musa, are you having an ADHD attack, or you can’t comprehend simple English? The conversation was not about suing for tort, but suing to overturn supposedly unconstitutional law. It is unconstitutional for the government to pass legislation that forces physical harm upon people; so why don’t you antivaxers have your day in constitutional court and bring all your scientific proofs that measles vaccine is harmful, and therefore it is unconstitutional for the government to use the power of law to force people to harm themselves? You idiots can’t prove anything scientific, that’s why you are taking the “religious rights” route, so that you won’t have to prove anything, just claim your voodoo dogma.

          • Angry man, according to you I can’t sue for tort and that is okay with you.

Let’s be clear; you are perfectly okay with the fact that I can’t sue a vaccine manufacturer in court, yet I can sue that very same manufacturer for all his other medicines that he manufactures, even for proven lifesaving drugs I can sue him, I just can’t sue him for his vaccines.

Have you red the insert of the MMR shot that Merck printed? It clearly states that on of the many possible side effects is death. yet, if you die from the MMR no one can go to court on your behalf.

Death is just one of the many side effects that the MMR manufacturer admits to, there are dozens more. Since you make believe to be familiar with law, you must surely be aware that I can practice my religious belief without you telling me how; meaning, I have my own legal right to interpret Venishmartem meod. espceially since death is listed as a possible side effect. Where there is risk, there must also always be choice.
Even our liberal Governor Cuomo understands that, based on his response today to vaccine regulation.

VAERS has reported more than 100 deaths from the MMR vaccine alone. There are many more deaths from all other vaccines. Vaers has paid out close to 4 billion in damage to vaccine injury.

According to a Ottowa Hostpial Research Institute study, 1 out of 168 babies that get the MMR vaccine are hospitalized within 4 days of the MMR shot. Some of the babies is the study died.

The CDC holds 50 patents on vaccines.

The US Congress has ruled that vaccines are unavoidably unsafe.

            Take that lawyer doctor anonymous.

      • You are a big Am HaAretz! Your alternate baloney facts don’t create halachos.
If an infinitesimal risk is something to act upon, stay off the road and don’t cross the street. I know many people killed in/by autos, so I’m obligated to warn you.

  4. I loved this Doctor’s explanation of those who don’t vaccinate especially now during this crazy measles epidemic.. Important info

A licensed pediatrician’s reply to those pushing vaccinations.

March 22, 2019— Dr. Ray Andrew MD:

“I am running into increasing numbers of patients/parents who decline to receive vaccinations. I don’t call them “anti-vaxxers” because that is the most immature way I can imagine to refer to another human being with an opinion, whether I consider it informed or not. Name-calling is what people do in politics when they don’t have an intelligent response to an opposing party’s argument or viewpoint. This is supposed to be science, not politics.

Based on my experience, those who choose not to vaccinate care just as much about their children as you and I do. But they are looking for information. They no longer consider the AAP and the CDC as unbiased sources of information because the former has ties to the drug industry and the latter actually owns vaccine patents. These parents want me to show them long-term safety studies, which I am unable to find. They are bothered by the ingredient lists of vaccines, knowing that there are EPA-listed toxins in many of them. Some don’t like knowing that cells and DNA from aborted fetuses as well as animals are used in vaccine production. Some demand true double-blind, randomized, placebo-controlled (using saline controls, not adjuvants) trials proving efficacy, which simply do not exist, even though we keep telling everyone that this is the gold standard in medicine. Some ask why—if informed consent exists for every other procedure in medicine—doctors and governments are trying to force vaccination on them, throwing informed consent (a legal right, I was taught) out the window. Some make the argument that, if vaccines are so effective, the vaccinated shouldn’t worry about getting sick from the unvaccinated. And they ask me for scientific proof of the theory of herd immunity. I don’t remember being shown any evidence of this in medical school. It was simply taught as a self-evident fact. But my patients don’t accept “facts” anymore, not without seeing some proof.

So, when I receive all of these communications from different organizations telling me how I am supposed to combat the growing threat of vaccine deniers, I feel like a straw man because these communications never present actual evidence to respond to the questions of these parents. They’re just talking points, empty claims, and official pronouncements.

In conclusion, some of my patients vaccinate, and some don’t. I respect both kinds. They are both intelligent and care for their children. Last I checked, the Hippocratic oath doesn’t require me to insult people with whom I don’t agree. I present what evidence I can find, and let them choose based on their values, not mine. Maybe that’s not allowed anymore. Maybe I’m supposed to kick them out of my practice if they disagree with me. Maybe they should be kicked out of school. Out of the country, even. If that’s the America of the future, that’s not a country I would want to live in.”

    • ‘Normal’ people used to espouse the benefits of voodoo and witchcraft. Would you have the same understanding attitude to them also?

      • “Normal” doctors used to say DES and thalidomide were safe. “Normal” doctors used to say smoking was safe. (There were ads in magazines by RJ Reynolds Tobacco Company saying “More doctors smoke Camels than any other cigarettes.”)
Sometimes the medical profession is proved wrong. That is why science is never settled…even, and especially, when it comes to vaccines, which do not undergo the same kind of testing as any other medical product.

        • If doctors can sometimes get it wrong, Kal V’Chomer a bunch of superstitious anti-vaxx looney birds can and do get things wrong.

          • Classic vaccinated response. Agrees that doctors get it wrong, and still injects his kids with a vaccine that can cause death – this according to the Merck insert. Vears confrimed that more than 100 babies died of the MMR. The US Congress ruled that vaccines are “unavoidably unsafe.”
But…we’re all superstitious becuase of a Kal vachomer – said the vaxxer.

  5. i am writing this to explain what the chareidi antivaxxers are saying. my children and einiklach have all been vaccinated but i do understand their religious objection.

a vaccine introduces something of the disease into the body which now will make the body to immune. as i understand it, their point is that ‘ushmartem me’od’ forbids one from introducing a disease into an otherwise healthy body

  6. The Torah forbids going to court.
They should take the mayor to bais din!
Bais din will issue a ruling after listening to both sides toanim.
The only fair way to resolve this matter.
