nat-lewin[Audio below.] Last night, an exclusive conference was held at the Sheraton Crossroads Hotel in Mahwah, NJ, to update community leaders and askanim on the recent revelations regarding the case of Reb Sholom Mordechai Rubashkin. The keynote speaker at the event was noted attorney Nathan Lewin, who is the lead appellate lawyer in the Rubashkin case. The assemblage also heard from Rabbi Menachem Genack, CEO of the Kashrus Division of the Orthodox Union, and Rabbi Pinchos Lipschutz, publisher of Yated Ne’eman and one of the leading activists in the Rubashkin case. Other speakers included Rabbi Shlomo Leizer Meisels, tireless askan, as well as Deputy Mayor of New Square Moshe Spitzer.

Mr. Lewin, in his remarks, detailed the sequence of events leading up to the breakthrough last week, with new documents produced in response to a Freedom of Information Act request showing that U.S. District Court Chief Judge Linda Reade met frequently with the law-enforcement team that was actively engaged in the planning of the May 2008 raid on the Agriprocessors kosher meatpacking plant and participated in preparations for the raid. On this account, Judge Reade should have been legally disqualified from presiding at the federal trial of Sholom Mordechai Rubashkin. While Judge Reade was required to disclose these meetings and her participation to defense lawyers, she did not make any such disclosures before presiding over the trial last year.

In addition to the various speeches at the event, Mr. Lewin took questions from the audience, clarifying many of the questions that people have had since the breaking news this past week.

Rabbi Lipschutz, in his comments, said, “We are here to protect not only Mr. Rubashkin, but all Americans, from such courts, from judges who are not impartial, and prosecutors who are unchallenged in their pursuit of true justice. As law-abiding citizens of this great country, we want to ensure that true justice is meted out to those who violate the law. We want to ensure that those who take advantage of others are properly prosecuted. And as President Obama stated when he nominated Justice Kagan, we want to ensure that everyone is given a fair trial and a chance to defend themselves under judges who are blessed with empathy as well as loyalty to the constitution of the United States.”

  1. matsav has posted 10 articles in a row or so that are more well written and with decent or better- content by matsav than over the last few weeks. Congratulations

  2. I am not so sure about the power of the recent disclosures. Judge reade’s participation in the preparations of th raid as well as the prosecutions of the illegals, etc., etc., has all been very well known. None of this is a sudden new surprize. I sure hope we have more powerful arguments.

  3. As we “help save the life” of Sholom Mordchai Rubashkin — which I agree is important — let us not forget to “help save the life” of Jonathan Pollard. Guess he’s been in jail too long to get any important press.

  4. The OU should have stood up for Rubasdhkin at the very beginning instead of saying we will stand behind whatever the government says.

  5. To # 4: Ahuva,

Pollard has gotten much press and we continue to do all we can for him, don’t throw cold water on the Rubashkin issue by trying to point to other cases,

Hopefully when we see justice for Sholom, we can continue to work on the other important problems.

  6. Where was the OU they till now? I remember reading the OU statement back then when it all started and thinking to myself this is a terrible thing to say in this situation. I guess Elel is the time to fix your mistakes

  7. Let’s not focus on the past, but rather give kudos to the OU for stepping up to the plate and doing the right thing. Let’s hope other major organizations follow suit and help us all in correcting this grave injustice.
