Biden Raises Idea Of Rotating Supreme Court Justices

Former Vice President Joe Biden indicated on Monday that he might be open to shifting Supreme Court justices to lower courts if elected president, noting that he hadn’t made any “judgement” yet on the issue.

“There is some literature among constitutional scholars about the possibility of going from one court to another court, not just always staying the whole time in the Supreme Court but I have made no judgement,” Biden said at a campaign stop in Chester, Pennsylvania.

He went on to say that “there are just a group of serious constitutional scholars, have a number of ideas how we should proceed from this point on.”

“That’s what we’re going to be doing. We’re going to give them 180 days God-willing if I’m elected, from the time I’m sworn in to be able to make such a recommendation.”

  1. What is this guy talking about? After President Trump’s landslide re-election be’ez”H he’s planning to appoint another 2 Supreme Court Judges, conservative judges, who will replace 2 that will be going out (coronavirused) now.

  2. Rotating? That would mean the same judge who ruled while sitting in a lower court will rule in the Supreme Court on the appeal of his own lower-court ruling.

  3. Interesting concept as long as he applies it to the Executive branch and takes a role as Mayor of Dover Delaware, while the Mayor of Dover becomes President.

  4. Biden could set the example by rotating to Vice Presidency, from day one, leaving Kamoola in charge of running the country, which was the Democrats’ intent all along. Better yet, since Joe kept repeating that he is running for his Senate seat, perhaps he should waste some time exchanging duties with whomever Delaware sends to that chamber…. What difference would his senile presence make in any of those positions?

  5. The whole idea of making Supreme Court justices permanent was so that they should not be beholden to any influence. If they can be “sent back to the minors” by whim of other politicians, the judicial branch will lose its impartiality which is one of the bedrocks of our constitutional system.

  6. Doing a thing like this is guaranteeing a biased partial supreme court.

    If Joe Schmoe on the supreme court knows he can be demoted if he rules not in accordance with the presidents political views he is going to think twice before doing doing so.

    Even if Biden has a set rotation policy based on time on the bench, what is to stop the next president from rotating judges whenever he feels like it?

  7. What a stupid idea. Who do you think will rule wheter such a concept is constitutional. That’s right, the supreme court. Any idea how they will rule?
