Farrukh Afzal, the 37 year old man accused of assaulting Lipa Schwartz in Boro Park last week, has had assualt charge upgraded to a hate crime.

Prosecutors initially said they believed that Afzal was acting out of “road rage” and that this wasn’t a case of Anti-Semitism. They originally charged him with attempted assault in the second degree, assault in the third degree, menacing and harassment.

Chaim Deutsch, the councilmember representing Boro Park took to Twitter to thank the DA for presenting the charge as a hate crime, writing:

TY @BrooklynDA for presenting a hate crime charge against the assailant in Sunday’s assault in Boro Park. It is important that, in a high-profile case like this, the attacker is held accountable for his actions. Kudos again to @BPShomrim for their role in apprehending the perp!

  1. How naive. The DA already showed that he wants to sweep this case under a rug, first he took out the hate crime charge, then he put it back in when there was bad publicity. There are no guarantees that he won’t take it out again when things quiet down, or that he won’t “incompetently” butcher the case on purpose, such as “mishandling” evidence or making sure that not a single frum Jew is on the jury. Oh, and Judge Ruchie’s bail lowering antics didn’t help either: now the defense can claim that if the “chasidic judge”, elected by the people of Boro Park, doesn’t feel that the defendant is dangerous enough to walk the streets by lowering the bail from the DA requested 35k to 15k, then the defendant must not be dangerous at all, and is in fact a harmless loveable fuzzball.

  2. Does Matzav think it’s loshon hora to reveal the name of the judge, elected by the people of Boro Park, who lowered the bail to a ridiculously low 15k?!
