Former Marine Daniel Penny has been formally indicted in the killing of Jordan Neely through the use of a chokehold last month.

A grand jury in Manhattan deliberated and reached its conclusion today following weeks of national outcry from liberals over Penny’s actions and the scrutiny placed on a mental health system that supposedly failed the victim.

While Penny, 24, was initially arrested on charges of second-degree manslaughter, the specific charges he faces under the indictment remain unclear.

Penny, who is currently out on bail amounting to $100,000, turned himself in to the police on May 12, nearly two weeks after the incident on an F train in Manhattan where he wrapped his arms around the wild man’s neck.

Penny’s legal team asserts that their client acted in self-defense, highlighting Neely’s disruptive behavior, consisting of yelling, screaming, and making threats toward fellow passengers as witnessed by onlookers.

In a series of released videos, Penny stated that his intention was not to cause harm or kill Neely when he restrained him. However, he felt compelled to take action due to the disruptive and threatening nature of Neely’s behavior, which posed a potential danger to women and children present. Penny emphasized that as a Marine, courage is a core value that involves confronting and managing fear rather than being devoid of it.

The recorded confrontation quickly escalated, resulting in Neely struggling and eventually losing consciousness, leading to his demise. Medical personnel were seen performing CPR on Neely within the subway following the altercation. The city’s medical examiner later determined the cause of death as a homicide, citing “compression of the neck” as the primary factor.

Neely had a documented history of mental illness and had encountered numerous issues with law enforcement in New York City. His family, after his passing, held authorities accountable for their alleged failure to ensure he received adequate care and called for Penny to face charges of murder.

Of course, race-baiter and rabble-rouser Al Sharpton proclaimed that the choking incident represented an attack on the collective community. Sharpton also expressed criticism toward the initial decision to release Penny following the killing, questioning the authority’s rationale in allowing him to return home to his family.

Penny is scheduled to appear in court again on July 17.
