Decision in Case of Rabbi Osher Eisemann Expected This Coming Week

On Friday, defense attorneys and prosecutors finished presented their details in the case of SCHI founder Rabbi Osher Eisemann.

Judge Joseph Paone, who was assigned to the case earlier this year after Judge Ben Bucca stepped away, heard all the evidence until mid-afternoon.

This coming week, Judge Paone is expected to hand down his decision whether to vacate the convictions.

The Eisemann Family asks community members to accept upon themselves to say one or two kapitlach of Tehillim each day for Osher ben Chana Frumet until a decision is rendered.

  1. I don’t know the circumstances of this situation. But the impression given is that this Rov was found guilty in a US Court.

    If he is innocent, then davening by itself is not appropriate and we all have a duty to take this up with the US Judiciary.

    Bearing in mind that I writing this comment on a news website mainly read by Heilige Yidden who are שומר תורה ומצות, we also have to remember that if this person is guilty, then תשובה is the answer, so here is a reminder of what to do:

    1. Leaving the Sin
    Leaving the sin consists of stopping the commission of the sinful act. One cannot do Teshuvah if one continues to do the sin, even if he or she were to perform the next three steps perfectly.

    2. Regret
    Regret consists in sincerely regretting one’s wrong action. One must be genuinely ashamed and embarrassed over one’s sins.

    3. Confession Before הקב”ה
    Confession before הקב”ה consists of an oral confession spoken out loud, in which one formulates in words the commitments and attitudes one has reached in his or her heart. One should say, “I have sinned, I have done such and such; I deeply regret my actions, and I declare before the רבונו של עולם, Who knows my innermost thoughts, that I will never do this sin again.”

    4. Acceptance for the Future
    Acceptance for the future consists of resolving in one’s heart never to commit the sin ever again.

    But…
    1. The above steps only work for sins committed בין אדם למקום; for sins committed בין אדם לחברו, one must first ask forgiveness from that person before השם will accept the Teshuvah.

    • You’re a sanctimonious idiot. Why don’t get off your filthy soap box and worry about yourself? Than maybe, just maybe, you’ll get a shidduch.

    • This is far from a typical case. Rabbi Eisemann did not do anything wrong. He was accused in a 9-count indictment, of which the jury acquitted him of 7. The remaining 2 were added on counts in which the judge changed during the course of the trial, and he was only guilty through a technicality. As someone who is very familiar with the case (and not related to the defendant), I can say with certainty that this is a classic case of a miscarriage of justice.

      The original judge recognized this and therefore only sentenced him to 60 days in prison. The prosecutors, however, were not satisfied and went to the appeals court, demanding 12 years in prison. The appeals court got the story wrong (This is a fact. they actually wrote completely incorrect details of the story in their decision brief. but there is nobody to talk to since the Supreme Court didn’t take up the case). The appeals court sent the case for resentencing with a harsher sentence.

      Now, a new witness came forward to testify on the original alleged crime. This is the ONLY eyewitness, and she directly counters the circumstantial evidence presented by the prosecutors during trial.

      This is NOT a case of defending wrongdoing. This is a case of a terrible injustice to a holy man who dedicated his life to help others.

      Hope this cleared up some of the confusion.

  2. @Richie. Just because someone is found guilty in a US court it doesn’t mean that he’s guilty. Especially in this case. If he is guilty of anything all he’s guilty of is an innocent harmless mistake. This person we’re talking about here is a true Tzadik. You should be ashamed to talk this way about him. Murphy is a Rasha for not pardoning him

  3. Governor Murphy can end this charade in a heartbeat if he should so desire. Unfortunately he couldn’t care less.
