Dershowitz: Single Digit Sentence for Rubashkin

alan-dershowitzBen Harris reports for the JTA: Alan Dershowitz has weighed in on the Rubashkin sentencing issue. In a two-paragraph letter this week to Judge Linda Reade, Dershowitz lays out his credentials as

 someone who was involved in developing the concept of “presumptive sentencing” and written on the subject. Then he renders his judgement:

“As someone intimately familiar with the thinking of those behind the sentencing guidelines, I am confident that they would have been distressed by the government’s position in this case and its misuse of the guidelines to try to secure a sentence well in excess of what Mr. Rubashkin’s actions, as well as his personal background, deserve.

“Those who supported the enactment of sentencing guidelines contemplated fairness and equal treatment for similarly situated defendants. The goal was to ‘avoid unwarranting sentencing disparities.’ A single digit sentence would satisfy all the legitimate goals of the criminal justice system.”

  1. Halevai, he should get a very short single digit sentence. He suffered enough already. I am very glad that Alan Dershowitz is standing up for him.

  2. I believe in justice and you should too. If he gets zero then why should the next guy be different? Maybe nobody should sit in jail and everyone should be allowed to do what they want because at the end of the day everyone has an excuse why they broke the law.

  3. To Rifka: I believe in justice also. But if you read the entire case and cases just like it, you will see that none of the others had to suffer the injustice and cruelty this man had to suffer. Thus, yes, at this point he did his time. Let him get 0. Vos art dir????

  4. We all believe in “justice”, however there are still people out there who simply don’t get it.
    By now there should not be any doubt that Rubashkin’s treatment throughout the process was harsher and more brutal than for any similar offense,
    If this is not a “Dreyfuss” scandal – driven by pure antisemitism – that I haven’t understood anything about jewish history.
    It’s time that all of us wake up and realize that while it looks like Rubashkin is on trial, the entire Jewish community may be on trial up above – kol yisroek areivim …
    It’s time to put all differrences aside and be mispallel togetehr to silence the mekatrigim.
