Florida’s ‘Stand Your Ground’ Law Ruled Unconstitutional By Judge

A judge in Florida ruled Monday that the state’s updated “stand your ground” law, which required prosecutors to disprove a defendant’s self-defense case at pretrial hearings, is unconstitutional, setting up a showdown that could make its way to the state’s top court.

Miami-Dade Circuit Judge Milton Hirsch ruled that the amendment to the law allowed lawmakers to overstep their authority, adding that it should have been crafted by the Florida Supreme Court in the first place, The Miami Herald reported.

The Florida Supreme Court had ruled in 2015 to shift the burden to defendants, requiring them to prove in pretrial hearings that they were defending themselves in order to avoid prosecution on charges for a violent act.

 

 

The controversial self-defense law came into the spotlight during George Zimmerman’s case in 2012, when the neighborhood watchman shot and killed the unarmed teenager Trayvon Martin in Central Florida.

Zimmerman’s attorney argued his client used force because he “reasonably” believed his life was in immediate danger. Read more at FOX NEWS.

  1. Appalling and Misleading headline, just to push your left leaning liberal agenda, and for reasons we can reasonably suspect why.
    The fact is that Florida’s Stand Your Ground law was NOT ruled unconstitutional, but rather just a new amendment to the law has been ruled unconstitutional, and only because it has been legislated from the wrong branch of the Florida Government.
    Why? Why all this fake truth bending and fact distortions reporting, WHY???? Is EVERYTHING just politics today?

  2. The big government fascists believe that the voters(through their elected legislators) should not be able to decide what laws they have – the oligarchy of unelected lawyers should be able to shot down “we the people” every time. The DemocRats are against democracy.

    Allow room for people to have differences of opinion on smaller stuff like these

    • This has absolutely nothing to do with the freedom of expressing an opinion, something that i respect everyone for their opinion that they are entitled to. But no one is entitled to mislead and create new facts, period, end of sentence.
