
An IRS whistleblower revealed that Delaware US Attorney David Weiss informed at least six witnesses last year that he lacked the authority to charge Hunter Biden outside Delaware and was denied the status of special counsel. The House Judiciary Committee now seeks to interview these witnesses. The disclosure made by Weiss during an October 7, 2022 meeting with top IRS and FBI officials contradicts Attorney General Merrick Garland’s sworn testimony, according to IRS supervisory agent Gary Shapley’s testimony to the House Ways and Means Committee last month.
Shapley stated that Weiss surprised them by stating, “I’m not the deciding official on whether charges are filed.” He further disclosed that the Biden-appointed DC US Attorney, Matthew Graves, did not permit him to pursue charges in his district. This meant that Hunter Biden, now 53, would not face tax charges related to “foreign income from Burisma [Holdings] and a scheme to evade his income taxes through a partnership with a convicted felon” in 2014 and 2015.
Shapley’s legal team identified four of the six witnesses present in the meeting as Baltimore FBI Special Agent in Charge Tom Sobocinski, Assistant Special Agent in Charge Ryeshia Holley, Shapley himself, and his boss, IRS Special Agent in Charge Darrell Waldon. The other two witnesses named were Shawn Weede and Shannon Hanson from Weiss’ office. House Speaker Kevin McCarthy has stated that Republicans will initiate an impeachment inquiry into Garland if Shapley’s account is corroborated. The House Judiciary Committee, led by Rep. Jim Jordan, is expected to summon each of the alleged witnesses for further investigation.
In the same October 7, 2022 meeting, Weiss reportedly stated that he had requested special counsel authority from the Main Department of Justice but was denied. Instead, he was instructed to follow a process that involved another President Biden-appointed US Attorney.
The Justice Department asserted in a statement that Garland and Weiss have consistently maintained that the Delaware US Attorney had full authority over the matter. Garland emphasized that Weiss was allowed to continue the investigation and make prosecution decisions as he deemed fit.
The White House downplayed McCarthy’s impeachment threat against Garland, calling it “unfortunate” and stating that it is not a priority for American families.
Shapley’s account of Biden-appointed US attorneys in DC and Southern California protecting Hunter Biden from serious criminal charges, which resulted in a recent misdemeanor plea deal in Delaware, was supported by another publicly unidentified IRS case agent assigned to the Hunter Biden investigation since 2018 during his deposition before the Ways and Means Committee.
Hunter Biden is scheduled to appear in federal court on July 26 as part of a plea deal reached with Weiss’ office after a five-year investigation into potential tax and gun crimes. The deal is still subject to approval by a judge. Hunter Biden was recently seen attending a state dinner for Indian Prime Minister Narendra Modi, accompanied by Garland, and later joined his father on a trip to Camp David.
