Jewish Press, 4/25/13: Jews for Ba’al Worship Win in District Court

The Jerusalem District Court handed down its decision on Thursday in The State of Israel vs. The Jerusalem Chapter of Jews for Ba’al Worship, who were arrested on April 11, 2013 while praying at the Western Wall. Judge Moshe Sobel decided against the police appeal, confirming there was no cause for arrest and that the Ba’al Worshippers did not disturb the public order.

The judge also declared that the Ba’al Worshippers are not violating the restriction in the law governing sacred sites, which says that visitors at the Western Wall are to pray and hold religious celebrations according to “local custom.” In the judge’s view, the “local custom” could be interpreted with national and pluralistic implications, and not necessarily the Orthodox Jewish customs of the city of Jerusalem.

Anat Hoffman, Chairperson of Jews for Ba’al Worship said, “Today Jews for Ba’al Worship liberated the Western Wall for all Jewish People. We did it for the great diversity of Jews in the world, all of whom deserve to pray according to their belief and custom at the Western Wall.”

Of course there was no such article in the Jewish Press. The actual headline that did appear: Women of the Wall Win in District Court and the text above is a verbatim reproduction except that “Jews for Ba’al Worship” is substituted for “Women of the Wall.”  The judge’s decision is a sterling example of judicial arrogance where the judge does not enforce the law but uses his power as a judge to arbitrarily impose his views on the public and in effect legislate law. If “local custom” at the Western Wall does not mean “Orthodox custom,” then of course it can only mean “any custom” that the judge happens to find suitable to his taste, effectively rendering the law meaningless. This would mean “local custom” includes:

  • Atheists of the Wall – Men and women holding hands with their eyes closed while fervently declaring, “God wasn’t, God isn’t, God won’t be” (repeat ad nauseam)
  • Cultural Jews of the Wall – Don’t pray but stand respectfully while eating very thick hot pastrami-on-rye sandwiches covered with mustard. They are strictly forbidden to use mayonnaise.
  • Witches of the Wall (not to be confused with Women of the Wall) – A charming group  who prance around in a circle with broomsticks while chanting, “Geben mir dem roobee slipperz” (Yiddish for “Give me the ruby slippers”)
  • Spartacusians of the Wall – Requires a quorum of at least a hundred men who keep repeating: “I am Spartacus!”  “No, I am Spartacus!”
  • Flower Children of the Wall – Aging Jewish hippies and young hippie wannabes who hold candles and sing “The Circle Game” by Joni Mitchell. Optional: Readings from “The Little Prince”
  • Koufax’s of the Wall – They gather only on Yom Kippur wearing L.A. Dodger jerseys and holding baseballs but don’t pitch.

How wonderful that cultural diversity has finally reached Jerusalem. Now, if only moshiach would come.

  1. It’s this kind of juvenille name calling that is seriously undermining any Haredi stance in the wider community. Comparing women of the wall to Ba’al and Lapid to Hitler only cause mud to come back directly in the face of the Haredi community. We were taught as kids that name calling was the most un-intelligent form of arguement

The judge is actually applying law – the law of the secular state – they didn’t cause unrest and therefore they are in the right by secular law which is applicable at the wall.

  2. This is wrong. I know and agree that Ms Hoffman et al’s primary aim is to provoke. But comparing what is is they actually want to DO at the Kotel to idol worship is wrong and going too far.

  3. Bit of a storm in a teacup really…

The most important place in the world for Judaism is the 150,000 sq.m. trapezoid platform in the midst of the Old City known as the Haram al Sharif; Noble Sanctaury; Temple Mount; Har Haybayit. The Western Wall/Kotel Plaza is close but no cigar. Jewish unity is required right now, not division.

  4. Very well said. Thank you!

BTW, this is what bothers the hater of Hashem so much – when their game and fallacy is played on them. They cry “no fair” when we make it fair.

  5. Love the Rabbi’s take on this. These women are truly witches. Now, B’H, a wonderful group of women have organized and are called “Women For the Wall”. These are religious G-D fearing women who have organized to go up against these machasheifot and want to come early Rosh Chodesh Sivan to the Kotel to daven & say Tehilim before the machasheifot arrive.
The agenda of the WOW was clear as day from the moment they started. Theirs is a very political agenda and the leader of this sick group has even admitted on BBC that their agenda is to take Torah out of Eretz Yisrael, chas v’sholom.

  6. rabbi averick is right such a stupid ruling allows for anyone to do anything!by extension I hope he realizes that now jews should be allowed on har habeit, singing missonary songs etc, etc. As one of the women who spend a great deal of time davening at the wall we have the right to daven without these masugas bothering us!!they’re not there to pray they’re there to start a fight.

  7. SAYING THAT THE WOTW DONOT CAUSE UNREST IS NOT TRUE. THEY ARE PROVOKING AND DISTURBING THE HUNDREDS OF FRUM WOMEN WHO ACTUALLY DAVEN THERE. THE COMMENT THAT WHAT WE NEED IS “JEWISGH UNITY” IS MINDLESS. MOSHE SHOULD HAVE TAKEN OUT A GUITAR AND SANG KUMBAYA BY KORACH, THE MEKALLEL, THE MEKOSHESH, THE EIGEL ETC. A LITTLE UNITY, EH?

  8. Where’s the “Like” button for this article?

We do not have “Achdus/Unity” with those who desecrate the Torah and our holy places.

  9. #1

If the UN made it legal, you would care how much..

Oh, according to the UN the occupation of the the kosel is illegal.

The Bagat”z loves to claim we are obligated to heed UN ,so their jurisdiction is null

  10. For those who find my article offensive, I would like to make the following statement: Even though I strongly disagree with what the Women of the Wall are doing I don’t hate them and if you read the article with a little bit of care you will see that I did not compare them to pagans. I was making the very simple point that if they are allowed to express their radical feminist interpretation of worship at the kotel, then any other group should be allowed to do the same. However, even though I don’t compare them to pagans, I still find them to be obnoxious, self-absorbed, and full of phony self-righteous zeal. LIke most leftists they are shamelessly hypocritical. One of the new progressive buzzwords is “bullying.” What are these woman doing if not “bullying” other worshippers at the Kotel?
