Judge Throws Out Federal Suit on Scranton Protester Arrested for Likening Bush to Hitler

_45462655_bush226apA federal judge has thrown out a civil rights suit filed by a northeastern Pennsylvania man arrested after holding up a sign likening President George W. Bush to Adolph Hitler at a parade. Forty-one-year-old Kurt Shotko of Scranton, Pennsylvania, filed suit claiming the arrest violated his right to free speech and police arrested him without cause.

Shotko and another man were convicted of disorderly conduct for blocking others’ views of Wilkes-Barre’s St. Patrick’s Day parade in 2005.

U.S. District Judge James Munley ruled Monday that the statute of limitations had run out on the First Amendment claim and cited the convictions in dismissing the wrongful arrest argument.

Shotko’s suit named the city of Wilkes-Barre, its police department, mayor and other officials.
