New York Gov. Andrew Cuomo, a Democrat, signed legislation on Tuesday prohibiting the sale of Confederate flags on public property, including at state and local fairs.
Cuomo was well aware that such legislation is likely to fail a First Amendment test, but this did not deter him.
“This country faces a pervasive, growing attitude of intolerance and hate—what I have referred to in the body politic as an American cancer,” he wrote. “By limiting the display and sale of the confederate flag, Nazi swastika and other symbols of hatred from being displayed or sold on state property, including the state fairgrounds, this will help safeguard New Yorkers from the fear-installing effects of these abhorrent symbols.”
Cuomo noted that “certain technical changes are necessary” to make sure the ban is compliant with the First Amendment, which protects free expression—including the expression of hateful ideas.

Hate speech is not protected under the 1st
Assuming you all like the idea of a ban on hanging a Nazi Satiska on state property, I’m not sure what you’re complaining about here.
It is not a question of what “I” like. The constitution prohibits the government from interfering with free speech (when that speech does not call for physical violence). And that also means the government cannot legally force you to listen to speech you don’t want (Democrats violate both aspects in all sorts of ways, but that is another story). If you don’t like certain speech then just don’t listen, and it will die of loneliness on its own. In fact, it is the very attention that it is given that gives it the publicity to linger on. Reminds me of what happened at my own synagogue. A woman stood outside the synagogue (on public property) and NOT blocking free access, with a sign about her religion (you can guess which). The security personnel told us just ignore her. In a couple days she was gone.
this is in essence a weather balloon trial for all sorts of other legislation.
It is just a hop, skip, and a jump from here to say that you cannot display your religiosity on public property because “religion is hateful towards women’s rights and lgbtq community”. Also on the grounds that religion is “pro-slavery”…..
essentially this is a PR stunt against all the religious groups that brought first amendment cases against the Governor, either you back the governor, and weaken the first amendment, or you make common cause with racists.
It’s an intentional catch 22 set by the virulently anti-religious left.
It will create a dichotomy between supporting hate groups and protecting the first amendment.
If he can get away with this, what will stop him from banning religious displays in public (think yarmulka, menorah) on the grounds that religion is anti lgbt?
“This country faces a pervasive, growing attitude of intolerance and hate”
Excuse me? We just had 80,000,000+ Americans voted for the Democrat, Joe Biden & Kamala Harris. How is that “hate”? The Democrat Party is all about love and tolerance. It’s only those evil wicked priviliged WHITE heterosexual Republican males that are bigoted racist homophobes. We’ve got the White House, Congress, and we’ll make sure we get the Senate in a few weeks. All the sports teams are eliminating their hateful racist names. We have the re-education camps ready. We have the internment camps ready. We’re going to tax the rich into oblivion. Why is this governor complaining? We are about to enter a state of complete euphoria and nirvana.
you believe that 80M people actually voted for them????
lets wait and see how many actual people voted for them.
And Biden has him on the top 5 list for Attorney General. AG is the top legal defense person in the country! I suppose that will nail his coffin when the Senate votes to approve his nomination.
Here’s where the spoken word reaches into the realm of manipulation. By drawing a parallel between the flags and the swastika, this rosho aimed to make all those who find the Nazi symbol abhorrent feel similarly about the flags. Well, the similarity is only in his imagination, and that’s one reason why this stupid bill will fail in court.
The Nazi symbol is one of hate toward Jews. This sentiment thrives in many places. Check the Governor himself, and the evil Mayor De Blasio. The spiking of anti-Semitic crimes and attacks has not dwindled, and these symbols push the agenda.
The Confederacy no longer exists. It was not a symbol of hate. It was a symbol of the states that chose to secede from the Union. There are many other symbols that refer to discrimination against blacks, and those should rightfully be subject to restriction.
The folly of Cuomo drawing a parallel is disappointing, but not surprising.
I guess he now joins DeBlasio in being a law breaker. Sanctuary Cities are against the law as well, yet the Mayor gives us his middle finger. If our Governor and Mayor can break any law they choose, I can break any one that I want.
