Just In: Levi Aron Charged With 2 Counts Of First-Degree Murder In Leiby Kletzky Case; Other Details Now Confirmed

charles-hynesFull updated report: A grand jury has indicted Levi Aron and charged him with two counts of first-degree murder in the case of Leiby Kletzky z”l.

Aron faces up to life in prison without possibility of parole if convicted, Brooklyn DA Charles Hynes (pictured) announced this evening. Aron’s arraignment is scheduled for July 28.

The eight-count indictment also includes a first-degree kidnapping charge.

Leiby’s death has been ruled a homicide and, according to the Medical Examiner. He was killed from intoxication followed by smothering.

Hynes said that Kletzky was given Cyclobenzaprine, a muscle relaxant; quetiapine, an anti-psychotic drug; and hydrocodone before Aron used a towel to smother the child.

Police also confirmed that they found a variety of pills in Aron’s apartment.

Police have confirmed that last Monday night, Aron drove young Kletzky to upstate Monsey, where he attended a wedding while the boy stayed in the car. Then they went back to Brooklyn, authorities said. The boy stayed in Aron’s apartment Monday night and all day Tuesday while Aron went to work.

Chief Police Spokesman Paul Browne said Leiby was killed either late last Tuesday afternoon or early Tuesday evening. That means he was likely alive for about a day after he disappeared.

Investigators spent a week straight at Aron’s home in Kensington, pulling out every piece of evidence imaginable, even digging up the backyard. Crime scene detectives will still be at Aron’s home removing evidence for the next couple of days.

Some of the boxes removed from Aron’s home contained a sizable quantity of other children’s clothing. Police will also be digging up Aron’s backyard again to see if there is anything that leads to other missing children.

Aron is being held in a psychiatric ward at Bellevue Hospital under tight security. His attorneys met with him for about two and a half hours on Tuesday and said their focus is on their client’s mental state. They are also seemingly already laying the groundwork for an insanity defense.

“All we can say at this time without going into specifics upon talking to him for quite some time is that there’s a severe diminished capacity,” said Gerard Marrone, one of Aron’s defense attorneys.

Marrone said his client still hears voices, and is trying to use loud music to drown them out.

Outside the Kletzky home, word of the gruesome news began to spread along with disbelief.

    Assemblyman Dov Hikind (D-Brooklyn) today applauded the 8-count indictment of 35-year-old Levi Aron for the kidnapping and brutal slaying and dismemberment of eight-year-old Leiby Kletzky who became lost last Monday afternoon on his way home from day camp en route to meet his mother. Leiby’s remains were subsequently found in both Aron’s freezer and in a dumpster several miles away from Aron’s residence. According to an official report released today by the medical examiner, Aron also drugged little Leiby with a combination of a muscle relaxant, an antipsychotic, Vicodin, and Tylenol before smothering him to death.

    In a conversation with Leiby’s distraught grandparents, Hikind vowed that he will not allow Levi Aron to get away with Leiby’s murder. “I reassured Leiby’s grandparents that justice will be served in this matter, that I will do everything in my power to ensure that Leiby’s killer does not walk. Aron’s attempt at an insanity defense is offensive to our community and to Leiby’s memory,” said Hikind. “I intend to be in that courtroom as often as I can, to show my support to Leiby’s family, and to send a clear message to Levi Aron that he will be held accountable for his unconscionable actions, that justice and goodness will prevail in the face of his sick and twisted behavior.”
    Hikind also praised Brooklyn District Attorney Hynes for his tough stance in prosecuting this case. “I have no doubt that DA Hynes is as committed as I am to making certain that Levi Aron is prosecuted and punished to the fullest extent of the law, and I am grateful for his personal involvement in this case.”
    Hikind noted that it is important for the entire community, and for all those who have been deeply impacted by this horrific story, to come to court and show their support as well. “As we learned from the incredible search effort for Leiby, our community, thank God, has the capacity to show great strength in numbers. We should once again come out to Brooklyn Criminal Court in a show of solidarity to drive the message home to Levi Aron that when he hurts one of us, he hurts all of us, and that there is a high price to pay for this heinous deed.”

The fact that this guy said tehillim and even corrected the mispronounciation of Leiby’s a”h name (and even clipped his beard) to me, indicates that he is not insane – because that is what a normal person would do to cover up, to show he has nothing to do with it. He obviously believed he could get away with it. That the mystery would remain unsolved. And in fact if it weren’t for the efforts of looking through all the videos, he may never have been discovered. Why he did it – that I can’t figure out. Violence is usually the result of terrible supressed anger that one does not have the maturity to deal with.

    A young, innocent, sweet boy on this earth for less than a decade.

    His life violated by a monster, then snuffed out in an act of unimaginable barbarism.

    What message lies therein?

    If Hashem has allowed this to happen, it is unquestionably a message for us.

    How many more messages do we need until we all wake up?

    How can we be so numb and insensitive to what’s going on around us?

    We hear of this korban, who serves to atone for our sins, yet we carry on with life as usual.

    Yes, we say the expected things such as, “What a tragedy!” “Hashem Yeracheim!” and more.

    We put on a sad face and sigh for a minute or two; we may even shed a tear or two.

    Then it’s back to “business as usual.”

    We continue our vacations.

    We continue our lunch dates.

    We continue peppering our speech with vulgarities.

    We continue watching forbidden items.

    We continue making disparaging remarks to our family and friends.

    We continue worrying more about dressing in style than dressing the way we should.

    We continue catering to our bodies at the expense of our neshamos.

    We totally miss the many messages that Hashem is sending us.

    Are we so numb and blind?

    How many more korbanos do we need?

    Do we need it right between the eyes, r”l, for us to finally take them seriously?

    This boy was the son, brother and korban of every single Jew on the planet.

    The amazing and heroic efforts of Acheinu Bnei Yisroel of all stripes and colors who united in the search for this boy are surely part of the message.

    He may not have been found as we all hoped, but his passing should leave us with the clarity to hold on to the achdus that was engendered.

    The outpouring of tefillos that were said and tears that were shed for this boy and his family may not have produced the results that we hoped for, but they were not in vain.

    Not one single tear, not one single prayer, was for naught.

    It is during times of pain and tragedy that Klal Yisroel gets their priorities straight and focuses on the right things instead of the mundane.

    We need to hold on to this focus and not require more messages to keep us anchored in achdus and tefillah.

    Yes, there may be some evil people amongst us, but, as a whole, Klal Yisroel is a great nation.

    Let’s all be greater than we think we have the capacity to be.

    Let’s all start taking life a little more seriously.

    Let’s add more Torah to our lives, more tzedakah, more mitzvos, more ahavas Yisroel….

    Let’s rid our lives of lashon hara, machlokes, sinas chinom, pritzus…

    Let’s show Hashem that we got the message…

    May the korban be accepted by Hashem and may our thoughts and actions not invalidate its powerful effect.

    May we be zoche to a rebuilt Bais Hamikdosh, where we can bring the kinds of korbanos that we can offer with joy.

    Perhaps if we did some real soul searching and internalized the many messages Hashem has been sending lately, we will be able to celebrate the 9th of Av this year instead of spending the day crying again.

  9. Some people are born under a mazel connected with blood- they are either a murder,shochet,mohel,or doctor. They have the free choice to choose to use their tendencies for good or bad. In this case, Mr Aron once worked as a butcher( using his tendencies to the good) and but now he acted as a murderer (in addition to a butcher).He obviously didn’t use his inborn tendencies for the good, and should be called a “rasha,” and not mentally insane .

  10. The problem with crimes like these is that it blows up the community and freaks people out. Some mothers and fathers then overcompensate and a siege mentality sets in. People are frightened to wander the streets when the true chance of assault or abduction hasn’t changed. There is a balance between allowing one’s children the freedom to develop some autonomy by walking to school, friends etc,. and wrapping them in cotton wool to live a cloistered, sheltered existence. It is going to be a stuffed up world if kids can’t kick a ball around the street sometimes. There is far more violence done in the secrecy of homes than in public spaces.

  20. Leiby A”H had a pure neshama and was a korban for us all. I just wonder what the message is that Hashem wants us to hear and take to heart. Is the cruelty of it a reflection of what Hashem sees in us. Yosef hatzadik noticed the changed expression of another prisoner, and that sensitivity led to Hashem elevating him and us. Do we really notice each other or care. it really is a time for teshuva, and may we be able to see ourselves clearly to do it right- besides my deep sadness i’m very disconcerted about why a Jew could do this and also why this happened to us.

  21. I believe the murderer must’ve been on these drugs himself. He may have likely been off them when he killed the child. For those people who are living out of the realm of reality, here’s the fact: Mental illness is unfortunately a very common sickness today. There are so many people in our community that are on these medications & are leading perfectly normal lives & you would never know it. Don’t be too shocked to learn that your next door neighbor may be one of them. When these people are off medication, they can’t always think or act ratinalitely.

  23. Look carefully at the clip of his attorney Gerard Marrone telling the press that his client hears voices and that he listens to loud music to drown out the voices.

    You will notice that when he says this piece about him listening to music to drown out the voices-he starts rubbing his nose vigorously in front of the cameras.

    It is a well-known and universally recognized sub-conscious nervous tick to cover up for lying. These lawyers obviously made the whole thing up.

    This murderer is not controlled by voices. Rather he is controlled by urges that he got used to not controlling, no matter how terribly off these urges progressively became. He made the choice to allow his urges to control him until he became an uncontrollable monster.

  24. If he was given Quietapine (Seroquel) does this mean that the murderer had access to psychiatric drugs? Was he a mental health patient in the past or was it perhaps one of his wives? Is there more to this history that we can learn?

  25. #39 is correct. people with severe mental problems are not responsible for their actions. we can’t possibly judge them. everyone stop talking and passing judgement on this situation. that is not for us to do. Hashem will take care of that. we have to do teshuva and daven.
