Attorney Nat Lewin has responded to Chief U.S. District Judge Linda Reade’s decision to deny a motion for a new trial for R’ Sholom Morechai Rubashkin following the sentence handed down after his arrest following the unprecedented immigration raid at the Agriprocessors plant.
Reade issued her ruling Wednesday, rejecting the motion filed by Lewin.
Sholom Mordechai, as readers of Matzav.com well know, was sentenced to 27 years in prison and ordered to pay $27 million in restitution.
Sholom Mordechai’s attorneys have argued that new evidence showed Reade, who presided over the trial, participated in planning of the 2008 raid at Agriprocessors Inc. in Postville and could not be impartial.
Lewin said Sholom Mordechai will appeal Reade’s decision.
“For a judge to brush it all away and say it’s not even worth a hearing when there is clear conflict is nothing short of outrageous,” he said. “The law is clear that what she did was wrong.”

Did anyone expect otherwise? Asking the original ganov to judge her own actions?
Where does Joe Lieberman stand on this?
How can a Judge, judge themself? Is that not a conflict of interest?
A Shtickel nogeya b’davar is what we call it.
Go American judicial system! Politically corrupt as usual
R’ SM deserves fair justice and I believe he will receive it soon. All this will be turned around. Reade is arrogant and doesn’t seem to really care in the slightest when she hands down multi decade sentences to first time offenders.
I don’t think anyone expected differently from her. She is a shakran, and a massive ba’alas ga’avah, and she will use her power as best as she can. She enjoys doing this. What she doesn’t know is that
Hashem is really the only Judge.
The tzoro is that RSM darf mitmachen, so our tefilah to HKBH that this gehenom should be over soon.
