New York Court of Appeals to Hear Yeshiva Education Case

New York – In a development that was received with great joy by the frum community, the New York Court of Appeals announced yesterday that it will hear the case against the education decree from the New York State Department of Education.

This is a very positive development in the decree that has been dragging on for several years, beginning with the regulations that the Department of Education introduced in September of 2022.

In March 2023, the PEARLS organization took the matter to court to fight it, and the judge accepted their arguments, stating that large parts of the regulations are illegal.

The state appealed this to the Appellate Division, which reinstated the regulations. PEARLS then brought the case to the highest court in New York, the Court of Appeals, though the chances of them agreeing to hear the arguments were quite slim.

Yesterday the good news arrived: the court accepted the case, and they will issue a ruling at the beginning of the next year, 2025.

The Court of Appeals rarely accepts cases, turning down the vast majority of petitions for review.
