Rav Ariel: Let Us Sacrifice the Korban Pesach on the Har Habayis

“This reality in which the Temple Mount is in Arab hands must end,” he said in an interview with Arutz Sheva today. “They must open the gates for us. There is no argument that there is a duty to make the Pesach sacrifice even if the Temple is not built.”

Rav Ariel calls upon the Chief Rabbis to demand the opening of the gates of the Har Habayis on Friday, the day of the Pesach Seder. “They should make a formal request to the government of Israel, to open the gates of the Temple Mount so we can sacrifice.”

“Everything is ready – there are clothes for the Priests, an altar and vessels – all they need to do is open. We have asked the Chief Rabbis several times but have received no answer until now,” he said.

The avoidance of making the sacrifice is a grave matter, he said. “We are afraid of our own shadow. What will happen if the gates of the Mount are opened? They are afraid of what others will say, but they do not fear as regards keeping the Torah and Mitzvot.”

A person who does not make the sacrifice is punished by “din kares,” he explained. “It is written: ‘that person shall be cut off from his people.'”

All the poskei hador in any of the Ashkenazi or Sefardi communities disagree with this psak.

  1. Rav Ariel seemed to think the Sinai Desert was part of Eretz Yisroel, why else would he have left Eretz HaKodesh to run a Yeshiva in Sinai. I think he thinks sparking a war with the Arabs will bring Moshiach. That or he’s still shikur from Purim.

    No this scenario should not unfold at this time.

    Yes there is a valid argument. Happy to explain more but not here.

On the contrary: Any and all entry to the Har HaBayis (Temple Mount) has been prohibited by Gedolei Yisrael (leading Rabbinical authorities) for many centuries because we all are Safek Temeii Meis (possibly ritually impure). As the actual location of the Batei HaMikdash (Holy Temples) on the Har HaBayis is in dispute, those who follow rabbi Ariel may be subject to Kares (premature death), R”L (G-d forbid).

    This long-standing Psak (Rabbinical ruling) was reaffirmed by over fifty Gedolei HaDor (leading Rabbinical scholars representing all streams of Orthodox Jewry) after the June ’67 capture of the Old City of Jerusalem in a Hodaah VeAzharah document (which I am emailing to the Editor).

    It is unfortunate that rabbi Ariel has become a Zaken Mamrei (a rebel) and potential Machti Es HaRabim (causing others to sin) on such a grave matter!

    The Chasm Sofer in YD 233 seems to Not have a compelling case against it. Fascinating.

    According to the chasm Sorer, 8 begadim are not necessary and neither is the need for Cohen meyuchas.

    Apparently, Rabbi Ariel holds that he is one of the Poskei Hador.

    All that aside, maybe the Tzibbur should really consider – what would we do if we had all of the elements needed to do Korban Pesach?
    Are we really afraid of our shadows?

    Where does it matter where he has smicha from? Nachman Bialik, one of the greatest Maskilim in history, learned in Volozhin! So please do not blame a rebbi if his student does not match up with his teacher. Do you scold rebbeim if their students go OTD?

  8. There is also kares for going to the har habayis when tamei – I know there is a shittah that u can bring the korbam pesach when tamei but it isnt eaten

  9. First we have to find a parah adumah – oh, wait, don’t the ashes of the new parah adumah have to be mixed with some of the ashes of the previous parot adumot? Guess we’ll have to wait for the Mashiach ben David haAmiti to find out where to get them.

    1) first of all tumah is hutra betzibur

    2) Korban Pesach does NOT require a mikdash, the makom is sufficient.

    3) Not bringing a Korban Pesach also carries with it kares, so it would override the prohibition of tumah in the mikdash

    4) According to the chassam sofer there is No need for the 8 begadim for the Korban Pesach.

  12. #6- There is an entirely different issue here besides for the tamei maas issue. Look at the mishna in zevachim 46b that requires a korban to be l’reich nichoach and the possuk in parshas bechukosai that a korban cannot be l’reich nichoach without a mizbaich. Also see the rambam in maasei karbanos.

    This leads to another issue of going to har habayis and not performing the avodah. Since there is no reich nichoach the avoda cannot be done. As such, a cohen is prohibited from entering the har habayis. The question is whether this applies to a zar. See the shaar hamelech, tosfos in yoma, chazon ish in machshirin and the binyan tzion 1 and 2.

  13. Before we condemn a Rav U’Mahnhig B’Yisroel, I would like to state that, acoording to most poskim that I am aware of, since bizman hazeh we are all t’mei meis, we can offer a Korban Pesach on Har Habayis.

    I believe I heard many years ago that the Rambam himself did exactly that when he came to Eretz Yisroel.

    Todays poskim do not want to start up trouble with the Arabs and for common sense reasons would rather not start trouble. However, we cannot get away from the fact that one who does not offer a Korban Pesach bizman hazeh is chayav koreis.

    I have offered a workable solution to Yeshivas Ateres Kohanim to shecht the sheep on a portable mizbayach in one of the tunnels that runs underneath Har HaBayis.

  14. This is NOT a simple matter, people. It is NOT something that must wait for Mashiach. It seems that the only issue is where on Har Habayis is there a safe place halachically to do this. The Rambam went there, and the Radvaz has a clear opinion of where it is permitted. I recognise that in our setting it is a minority view to allow anyone there after mikva etc but there is NO Sanhedrin and you simply can’t call someone who is no less Musmach than the other Musmachim a Zaken Mamre. You can say it is an extreme minority opinion, but you don’t need to hurl abuse etc. Even R’ Elyashiv’s grandson went there, as is known.

    However since the churban beis hamikdosh, have

    we heard or have a Kabawla from any Gedolei

    Yisroel that one is obligated to perform the

    kawborn Pesach on the 14th of Nisson.

  16. To all those that think they are bigger talmidi chachomim then Harav Areil It is well known that Rav Chaim Shienberg ztz”l didn’t stay in Eretz Yiroel for Pesach because of this problem I also heard in the name of a well known chasideshe rebbe that this is indeed an issue.

    You write that Rabbi Sheinberg did not stay in Eretz Yoisroel for this reason.
    Did he call upon the Chief Rabbis to open etc. as this Gaon HaGaonim does?
    By the way, to be “b’derech rechoka” you do not have to leave Eretz Yisroel.
    In any case I really enjoy myself with all these lomdishe svoros submitted.
