Rav Wosner: Construction Permitted

rav-wosnerAs the construction freeze in Judea and Samaria ended this week, many are concerned that after a very short interlude in which construction will be allowed, Israeli Prime Minister Netanyahu will soon re-implement the construction freeze, perhaps as soon as next week.In light of these concerns, those living in the affected areas are trying to get as much construction done in as short a period of time as possible. They will be building 24 hours a day for as long as they can.

A group of avreichim from Modiin Ilit went to the senior posek, Rav Shmuel Wosner, rosh yeshiva of Yeshivas Chachmei Lublin and author of Shu”t Shevet Halevi, with a question of whether or not they can start construction immediately as the freeze ended, even though it is Chol Hamoed, when normally any work that can be delayed is.

Rav Wosner’s responded immediately that it is permitted to build.

[Chief Rabbi Shlomo Amar was also asked about whether or not it would be permitted to build during Chol Hamoed. His response was that it is permitted because the mitzvah of yishuv Eretz Yisrael takes precedence over the rule of minimizing work during Chol Hamoed.]

  1. Was wondering whether the Chief Rabbi, Rabbi Amars psak is nogeia always, or is it just now when the building in eretz yisroel is under threat of delay? And, was also wondering what Rabbi Wosner holds on general building which maybe lifi the svuru of Rabbi Amar that Matzav.com is describing here, is always permitted, on Chal Hamoied, due to the general mitzvah tmidi of Yishuv Eretz Yisroel?
