Special Counsel Jack Smith Stands Down In Trump Classified Docs Case, Asks Court To Halt Appeal

Special counsel Jack Smith formally requested on Wednesday that a federal appeals court pause his ongoing appeal in the classified documents case involving President-elect Donald Trump, referencing the recent outcome of the 2024 presidential election as a key factor.

Smith informed the 11th Circuit Court of Appeals in his letter that “As a result of the election held on November 5, 2024, one of the defendants in this case, Donald J. Trump, is expected to be certified as President-elect on January 6, 2025, and inaugurated on January 20, 2025.” He emphasized that the election’s result is a unique situation that necessitates careful review.

In his submission, Smith respectfully asked that the court “hold this appeal in abeyance — and stay the deadline for the Government’s reply brief, which is currently due on November 15, 2024 — until December 2, 2024, to afford the Government time to assess this unprecedented circumstance and determine the appropriate course going forward consistent with Department of Justice policy.” This additional time, he argued, would allow the Justice Department to evaluate its next steps within the bounds of policy.

The case surrounding the handling of classified documents was previously dismissed in July by Judge Aileen Cannon, a federal judge in Florida. Smith had initially moved to challenge her decision, leading to this appeal.
