Subway Hero Daniel Penny Pleads Not Guilty to Killing Jordan Neely

Daniel Penny, the 24-year-old hero captured on video choking Jordan Neely to death on a Manhattan subway last month, pleaded not guilty to charges of second-degree manslaughter and criminally negligent homicide on Wednesday.

It was the expected outcome of Penny’s arraignment, as he explained earlier this month that Neely—who was making threats to subway riders before Penny subdued him—would have killed someone if he didn’t intervene.

Penny, a white U.S. Marine veteran, was seen on video placing Neely, a 30-year-old black man, in a chokehold for several minutes while two others pinned Neely’s arms and legs to the ground.

Penny’s lawyers say he didn’t mean to kill Neely and that he was acting to defend himself and others, while Neely’s family assert their loved one was slain in cold blood. If convicted on both charges, The Messenger reports Penny faces a maximum of 15 years in prison. Read more at The Messenger.

  1. this is very bad for subway riders and any New Yorker that wants to save innocent people from hoodlums – shows the wrong example by indicting an innocent man who defended himself and other riders.
