
Breakfast food giant Kellogg’s is being sued for $5 million by an Illinois woman who says the filling in the strawberry Pop-Tarts are mostly other fruits.
Anita Harris is suing because she says the filling used in the Whole Grain Frosted Strawberry Toaster Pastries are mostly other fruits.
According to Kellogg’s Smart Label, dried pears and apples are listed as ingredients before strawberries.
In the lawsuit, according to WIVB 4, Harris says that the red food coloring also gives a “false impression” that the breakfast pastries contain more strawberries than they actually do.
“Whether a toaster pastry contains only strawberries or merely some strawberries … is basic front label information consumers rely on when making quick decisions at the grocery store,” the lawsuit reads.
“Strawberries are the Product’s characterizing ingredient … [consumers] believe they are present in an amount greater than is the case.”

Well, Stella Liebeck was awarded by a jury $3,000,000.00 from McDonald’s (she was burned badly on her legs by their purposely overly hot coffee) after they arrogantly refused to settle with her for $20,000 to cover her medical expenses, etc… Read up on that famous case. It wasn’t so pashut. Typical arrogant big corporation. They gambled and lost. Once something goes to a jury, you never know what might happen. I hope there will be major lawsuits with Big Pharma over their deadly unapproved vaccines.
Stella liebeck should have been burned on her other leg for filing such a frivolous lawsuit. It’s ridiculous that these lawyers can blackmail companies at will in the hope that they settle
You obviously know nothing about that case. Why don’t you educate yourself? A simple google search will explain to you what really took place and the extent of McDonald’s negligence.
But the judge greatly reduced to award, and in the end they settled for an undisclosed amount so as to avoid a appeals process.
I recently bought some cholent from a restaurant, and served it to my guests. I overheard one of my guests grumbling: “You call this cholent!!?? There is not one bean in here, and barely any potatoes! Yuk! Pass me the kishka.”
That should be an easy $5 Million for me, I hope.
Finally some important news, for a change.
While it seems like a frivolous lawsuit, there is the truth in labeling law. This would fall under that. The main fruit in a Strawberry Pop Tart should be strawberry- unless it’s actually called a strawberry flavored pop tart in which case the label isn’t necessarily untrue.
Cholent by definition does not have to have beans. Or potatoes. So that suit wouldn’t fly.
