In an appeal to the Supreme Court, President-elect Donald Trump is seeking to halt the sentencing scheduled for Friday in his New York business records matter.

This morning, Trump’s legal team petitioned the nation’s highest bench after courts in New York declined to delay the sentencing by Judge Juan M. Merchan, who oversaw Trump’s trial and conviction last May on 34 felony charges related to falsifying business records.

Attorneys for the president-elect requested an immediate suspension of Friday’s proceedings “to prevent grave injustice and harm to the institution of the Presidency and the operations of the federal government.”

In response, the Supreme Court called for New York prosecutors to submit their arguments by Thursday.

Judge Merchan has indicated that no incarceration, fines, or probation will be handed down.

Trump’s defense has pointed to a Supreme Court decision granting him broad protection from criminal prosecution as they attempt to overturn his conviction in New York.

Although that ruling came from a separate case, Trump’s lawyers contend that it means certain evidence used against him in the hush money trial should have been shielded by presidential immunity. Merchan has not agreed with that viewpoint.
