Why Did JNF Desecrate Shemittah?

JNF chairman Avraham Duvdevani said that although the JNF normally abstains from planting trees on shemittah, exception is made for trees planted for security reasons or to protect land from illegal incursion.

By the same token, MK Itamar Ben-Gvir of Religious Zionism and other MKs traveled to the Negev amid the Arab rioting to participate in tree planting. Ben-Gvir said he had received a psak from Rav Dov Lior, the former rov of Chevron and Kiryat Arba, that the struggle for Eretz Yisroel has precedence over shemittah observance.

In response, Rav Yosef Efrati wrote that there is no heter to plant trees to prevent non-Jews seizing land, since the same could be achieved by having guards patrol the area.

    • The Torah says “No planting”. Period. There is no exemption.
      Working through an Otzar Beis Din allows you to work the fields to an extent, but plants and trees which do not bear fruit are not part of the Otzar Beis Din framework, so you couldn’t even use that as a bypass.

      It’s not a matter of having a different psak, it’s a matter of allowing political considerations cloud the subject.

      • Umm, Alex, the Mishnah in Shevi’is 6:1 says otherwise (as does the Rambam), that there are exceptions — and the area where these trees were planted might very well be one of them. Of course, one could disagree about the psak in this case, as one could disagree with Rav Efrati’s, but it’s a good idea to know what one is talking about beforehand, especially before saying that Rav Lior, unlike Rav Efrati !!!!!, is allowing political considerations to cloud the subject.

  1. JNF did not desecrate Shemittah.
    The planting took place in the Negev, in accordance with Rav Lior’s psak that tree planting would be permitted south of Beer Sheva as part of the struggle with the Bedouins over control over the Negev and as part of the MITZVAH of settling Eretz Yisroel, which is Torah-mandated, while Shemittah is not only d’Rabbonon, but might not apply at all south of Beer Sheva, which is where the planting took place.

    sorry not that you do not respect him or his psak. that’s your issue. Charedim do not have a monopoly on poskeim.
