Women and the Sukkah

sukkah8Women are not obligated in the Mitzvah of Sukkah, (but are permitted to perform the mitzvah of eating in the Sukkah). Nevertheless, Ashkenazim generally, (and some Sefardim) have the custom to permit women to make the beracha of “Layshaiv Ba’sukkah”. (Shulchan Aruch w/Mishnah Berurah 640:1, Piskei Tshuvos 640:1)

However, Sefardim generally (and some Ashkenazim) have the custom to prohibit women from making a berecha of “Layshaiv Ba’sukkah”. (Piskei Tshuvos 640:1)

Hilchos Sukkah – Review

If one placed the S’chach onto his Sukkah while the awning was covering the Sukkah one should, L’chatchila, pick up each piece of S’chach and lay it down again while the awning is in the open position. Bidieved if one just moved around bunches of S’chach this also suffices. (Shulchan Aruch w/Mishnah Brurah 626:3, Kovetz M’Beis Levi 3 Citing psak of R’ Shmuel Wosner)

If one did not realize that the awning was covering the Sukkah at the time that the S’chach was placed down until after the start of Yom Tov, one may no longer move the S’chach because the S’chach (and the Sukkah and all decorations) are Muktzah. (Shulchan Aruch w/Mishnah Brurah 626:3, Piskei Tshuvos 626:5, Kaf Hachaim 36)

Nevertheless, one is permitted to use the Sukkah and even make the beracha of “Layshaiv BaSukkah” because in this circumstance we rely on the lenient opinions of the Ramah and other poskim who hold that this is not a problem.
