Kiryas Yoel, NY – Four municipalities have sued to invalidate the state permit issued in October for a major Kiryas Yoel well in Cornwall, arguing that the village and state Department of Environmental Conservation failed to adequately examine its potential impact and protect neighbors whose own wells could be affected.
The case, filed last week in state Supreme Court in Albany, challenges the DEC’s decision to allow Kiryas Yoel to pump up to 612,000 gallons per day from a well on a patch of land it owns next to Route 32 in the Mountainville section of Cornwall.
The well would be connected to a water pipeline the village is burying next to Route 32 to tap the Catskill Aqueduct in New Windsor, about seven miles beyond the well site.
The lawsuit reprises objections that municipal officials, environmental groups and property owners raised last year, when the DEC held a public hearing on the well permit. Attorneys for the town and village of Woodbury, Town of Cornwall and Village of Cornwall-on-Hudson contend the well could lower the nearby Woodbury Creek, cause water shortages for neighbors and transfer a massive amount of water from the Moodna Creek watershed to the Ramapo River watershed, where Kiryas Joel’s wastewater is emptied.
