DISGRACE: NYS Supreme Court Rules That YU Has to Support “Alternative Lifestyles”

Late Tuesday afternoon, the New York State Supreme Court ruled that Yeshiva University in New York City as to recognize and support -on an equal basis with all other school clubs – the YU Pride Alliance, which promotes alternative lifestyles.
Of particular note, Matzav.com points out, is the language on page 7 of the decision stating that Yeshiva University’s charter says that it “is organized and operated exclusively for educational purposes.”
The court averred that “Yeshiva is a university which provides educational instruction, first and foremost. Yeshiva’s religious character evidenced by required religious studies, observation of Orthodox Jewish law . . . are all secondary to Yeshiva’s primary purpose.”
This is a decision with troubling implications for the future. It is an indication of courts pushing the new social norms of our progressive society. This was a lower court decision that will be appealed, but if this stands, it will not be the last application of this principle.
Matzav.com points out that this reinforces our community’s need to stand up for yeshiva independence and sends a message to a part of the Orthodox society that has – until now – been less concerned with government oversight of New York State’s yeshivos.

  1. Needs a new charter. The problem is that efforts to be or look non-sectarian can backfire mightily in today’s cultural climate.

  2. I get to read college brochures and newsprint and the scrappy schools have been featuring this in their brochures. All the kid does is paint her hair and she or he gets their photo in the college material.

    Screen your schools.

  3. This country is doomed. Lib progressive judges who infest the entire country are destroying it , including Supreme Court of US except for 3 who refused to allow investigation of voter fraud.

  4. You can’t have it both ways. It seems from the article, that Yeshiva University’s main purpose is as a University “exclusively for educational purposes.” This is probably a drastic change from it’s original charter which I would assume was as a Yeshiva or Shul. The change is usually done to be eligible for government grants. (Harvard started as a divinity school)
    The same problem that the NY yeshivos are having. They take money for providing education, then complain when the state wants to impose educational standards.
    The gedolim in Europe warned 100 years ago, if you take money, they will tell you what to do. Nothing is ever new in this world.

    • Taking money has nothing to do with NYS proposed regulations. They would apply whether you take money or not.

    That logic could be R’L used against any Yeshiva. Particularly those that offer a secular education.

    Even if the court were correct that they are secondary to Yeshiva’s primary purpose how would that lessen the religious persecution involved?

    And why can’t a school promote one club over another?

    Say you have a school with clubs that promote making blood donations or helping the elderly. They also have clubs that promote drinking beer or sports betting. Why should the school need to promote them equally?

  7. YU must now split up into independent divisions. The Torah division will then have a legitimate claim to a religious exemption from these regulations.

    How soon will it be before some Hebrew Christian missionary student group demands similar rights and recognition at YU?

  8. these are probably the same people who are trying to get back at their parents through the NY board of education. what are these guys doing in YU? they are certainly not there to learn Torah.   9. If there was any Jewish integrity in that institution they would close up shop. Like they did in Volozin. For way less.

  10. Its very sad that your reap what you sow. Alas they’ve had no problem with these groups on campus.

    The bigger issue is that this is another shtup into Jewish education. If it can happen on why you, I can happen at any other Yeshiva as well. All you need is some moron to bring up a lawsuit. Look what’s happening with the education. You have a major loser involved and it’s turning over education.

  11. The real problem is page 11 which quotes the law that David greenfield and chain Deutsch voted for that limits religious exceptions. Today they apply to yu tomorrow bobov
