Former VP Mike Pence Won’t Be Charged Over Classified Documents

According to a source familiar with the matter, the investigation into classified information mishandling at the Indiana residence of former Vice President Mike Pence has been closed by the FBI. The Post was informed of this development on Friday. The Justice Department, as reported by CNN, sent a letter to Pence’s attorney confirming that they will not pursue charges.

A representative of Pence’s team told The Post that they were “pleased but not surprised” by the outcome. This news comes just five days before Pence is set to enter the 2024 presidential race, joining a crowded field that includes Donald Trump, his former boss, and Ron DeSantis, the Governor of Florida.

In January, approximately twelve documents with classified markings were discovered in two boxes at Pence’s home outside Indianapolis. The FBI retrieved the boxes three days later. Following revelations of President Biden improperly storing sensitive material, Pence had instructed his lawyers to search his home.

On February 10, federal agents conducted a five-hour search at Pence’s Carmel, Indiana residence. During the search, one document with classified markings and six additional pages without markings were found, which were not initially discovered by the vice president’s counsel.

It was reported that the documents found had originated from the vice presidential residence at the Naval Observatory in Washington, D.C., as well as a West Wing office drawer. Pence took full responsibility for the presence of these documents at his home, acknowledging that mistakes were made.

Both Biden and Trump are also under investigation for potential violations of federal law regarding classified material. The FBI raided Trump’s Mar-a-Lago resort in Florida in August to retrieve numerous documents. Attorney General Merrick Garland appointed prosecutor Jack Smith as a special counsel to investigate potential law violations by Trump.

In Biden’s case, approximately ten classified documents were found initially while clearing out his former office at the Penn Biden Center in Washington. More classified documents were discovered in December next to Biden’s vintage Corvette in his garage and during subsequent searches at his home. Special counsel Robert Hur was appointed by Garland to investigate Biden’s handling of documents.
