Non citizens voted in all elections in New York throughout most of the 19th century and it wasn’t an issue. However a new Constitution went into effect in 1894, and a 1938 amendment appears to make elections only for citizens. There is nothing in the US Constitution that prohibits non citizens from voting and the Supreme Court ruled a long time ago that citizenship had nothing to do with voting rights.
State rights supercede. That’s according to all scholars. That’s what the entire overturn of Roe vs Wade was about. The Us constitution doesn’t offer such rights. The federal government can’t enact such laws. Ruth Ginsburg said all along the law was terrible, but she wouldn’t overturn it. Ultimately why, because she was a chicken to fight for the constitution. The overturn didn’t say abortion is illegal, it said the fed government doesn’t have that power, but the states do. Therefore in NYS where life has no value partial birth abortion is legal. As are other crazy things.
