Judge Grants Evidentiary Hearing on New Eisemann Evidence Today

A judge ordered an evidentiary hearing to air new evidence that arose in the case of SCHI founder Rabbi Osher Eisemann after a witness came forward to testify that the transactions at the center of his convictions were not made by him and were not criminal in nature.

At a hearing this morning in the Middlesex County court, Judge Ben Bucca noted that the new evidence should be added to the court record, and he wished for it be presented at a hearing. He noted that he will allow both parties to submit written briefs before the hearing, which has yet to be put on the schedule.

As was reported here previously, attorneys for Rabbi Eisemann filed a motion in June requesting that the two convictions be vacated and a new trial be mandated after a former SCHI bookkeeper came forward and testified in a signed certification that the QuickBooks entry that the prosecutors had pointed to as criminal activity was made by her, and not Rabbi Eisemann. In addition, she testified that her entry was intended to balance the books and not erase a debt as the prosecutors suggested, and was therefore not criminal activity. She explained that at the time of the trial, she was no longer employed by SCHI, and she was never interviewed by the state. She wrote that she did not come forward to the defense team or anyone because she was unaware of the specific allegations made against Rabbi Eisemann or that they involved her entry into QuickBooks. The defense team asserted that based on her testimony, the transaction for which Rabbi Eisemann was convicted never took place, and a new trial is warranted so that the jury can hear the new testimony.
