A retired New Mexico state senator who came to the Big Apple to pursue a career as a playwright is suing his Manhattan building manager, saying his Hell’s Kitchen apartment is just too noisy.
He cites “thundering and shrilling noises” from construction inside the building starting at 8 a.m., according to papers filed last week in Manhattan Supreme Court.
The noise sent him to the ER where he was diagnosed with a “breakdown of body function because of extreme exhaustion,” according to court papers.
Joseph Carraro’s high-rise rental faces West 42nd Street at 11th Avenue and also happens to overlook the noisy Lincoln Tunnel entrance.
He’s suing the building’s manager, George Laitsas, for $114,375, and accuses the leasing company of a bait and switch by moving him into the 42nd Street side of the building instead of the 43rd Street side he initially agreed on, court papers read. Read more at NY POST.

Mr Digger. have you lived there ? If not how do you know what it is like. And maybe he became off the wall or certified nut case because of the noise.

I hope the court makes him pay all the costs of this lawsuit.
